That the City Council, by Motion, award the contract to the lowest responsible bidder, CEM Construction Corporation, of Montebello, CA, Contractor’s License No. 951234, Classification A, B, C-8, C12, C21, and C27, in the amount of $1,721,945.50, for the Lincoln Avenue Sanitary Sewer and Street Improvements from Dale Avenue to Magnolia Avenue (Project); direct and authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine that the Project is Categorically Exempt from California Environmental Quality Act (CEQA) pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the California Code of Regulations (CCR).

DISCUSSION:

The bids are summarized as follows:

1. CEM Construction Corporation, Montebello, CA ....................................$1,721,945.50

2. Vasilj, Inc., Irwindale, CA ........................................................................$1,943,563.00

3. GRBCON, Inc., Baldwin Park, CA...........................................................$2,295,333.90

4. Aid Builders Inc., Los Alamitos, CA ........................................................$2,718,997.50 This Project will address ongoing sanitary sewer maintenance and capacity issues in the City’s West Anaheim area by improving the overall performance, reduce maintenance costs, ensure capacity for future development, and ensure the reliability of the system.

The work consists of replacing an existing 12-inch sewer line 650 feet west of Magnolia Avenue with a 15-inch sewer line, replacing an 8-inch sewer line with a 12-inch sewer line west of La Reina Circle, and replacing a 12-inch sewer line with a 21-inch sewer line connecting to an Orange County Sanitation District trunk line. The total length of the sewer improvements for the Project is approximately 740 linear feet. Additionally, the Project will include street repaving on Lincoln Avenue from Dale Avenue to Magnolia Avenue. The bid price is higher than the engineer’s estimate of $1,463,382.00, but reflects the current bidding environment, appears to be reasonable, and is within available funding. Liquidated damages for this Project shall be $1,600 per day.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the CCR which consists of construction and location of limited numbers of new, small facilities or structures and specifically exempts water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction. After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions.

IMPACT ON BUDGET:

Adequate funding is available in restricted transportation, wastewater, and sanitation funds, as part of the Public Works FY2022/23 budget, and in Water Utility funds as part of the Public Utilities FY2022/23 budget.

Respectfully submitted,
Rudy Emami
