CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 25, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: COOPERATIVE AGREEMENT WITH THE CITY OF PLACENTIA

FOR THE JEFFERSON STREET, VAN BUREN STREET, AND

RICHFIELD ROAD REHABILITATION
ATTACHMENT (Y/N): YES ITEM # 16
RECOMMENDATION:

That the City Council, by Motion, approve the Cooperative Agreement (Agreement), in an amount not to exceed $350,000, for the construction and administration of the Jefferson Street (Orangethorpe Avenue to Miraloma Avenue), Van Buren Street (Orangethorpe Avenue to s/o Miraloma Avenue), and Richfield Road (Orangethorpe Avenue to La Palma Avenue) rehabilitation, and direct and authorize the Director of Public Works or designee, on behalf of the City of Anaheim, to execute the Agreement and any related documents, and to take any and all actions as are necessary to implement and administer the Agreement.

DISCUSSION:

The City of Placentia (Placentia) is performing their FY 2021-22 Arterial Roadway Rehabilitation which includes roadway segments on Jefferson Street (Orangethorpe Avenue to Miraloma Avenue), Van Buren Street (Orangethorpe Avenue to s/o Miraloma Avenue), and Richfield Road (Orangethorpe Avenue to La Palma Avenue) (Project).

Since only a small portion of these segments lie within the City of Anaheim (Anaheim), it will be more efficient and minimize the inconvenience to the traveling public if Placentia rehabilitates the Anaheim portion of the roadway at the same time.

The work consists of the resurfacing and reconstruction of the asphalt concrete pavement, removal and reconstruction of curb & gutter, sidewalk, driveways, adjustments of utility structures, signing, striping, and other miscellaneous items of work.

The entire Placentia Project cost is estimated at $5,449,254.20. Anaheim’s pro-rata share in the three roadway segments is estimated at $317,700.71, or around 6% of the total Project cost. As this is an estimate, staff is seeking approval of a not-to-exceed amount of $350,000 which includes a contingency for additional or unforeseen work. Anaheim’s final cost will be based on the actual cost upon completion. Anaheim will reimburse Placentia its pro-rata share of the actual cost within 45 days of being invoiced.

This Cooperative Agreement between Anaheim and Placentia outlines the respective roles and responsibilities and stipulates that Placentia will be the lead agency for the design, environmental, construction, and administration of the Project.

Construction is anticipated to start in the Fall of 2022 and should be completed during the Winter of 2023.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), Placentia, as Lead Agency is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, Placentia recommended that the Project is Categorically Exempt from CEQA pursuant to Class 1, Sections 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency‘s determination.

After determining that this Project was Categorically Exempt from CEQA, Placentia filed a Notice of Exemption.

IMPACT ON BUDGET:

Adequate funding is available in restricted transportation and Water and Electric Utility funds in the Department of Public Works and Public Utilities Department’s FY 2022/23 budgets.

Respectfully submitted,
Rudy Emami
Director of Public Works
