CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 25, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: RIGHT-OF-WAY ACQUISITION SERVICES AGREEMENT

WITH OVERLAND, PACIFIC & CUTLER, LLC FOR THE

CITYWIDE SAFE ROUTES TO SCHOOL SIDEWALK GAP

CLOSURE PROJECT
ATTACHMENTS (Y/N): YES ITEM # 15
RECOMMENDATION:

That the City Council, by Motion, approve an Agreement with Overland, Pacific & Cutler, LLC (Agreement), in the amount not-to-exceed $69,316.79, to provide right-of- way acquisition services related to the Citywide Safe Routes to School Sidewalk Gap Closure (Project), and authorize and direct the Director of Public Works or designee, on behalf of the City of Anaheim (City), to execute the Agreement and any related documents, and to take any and all actions as are necessary to implement and administer the Agreement.

DISCUSSION:

As part of an ongoing effort to enhance safety near schools, the Department of Public Works applied for and received a California Department of Transportation (Caltrans) Active Transportation Program (ATP) grant to construct new sidewalks around various parts of the City (on Acacia Street, La Palma Avenue, Frontera Street, and Santa Ana Canyon Road). The City is the lead agency for the environmental, design, right-of-way, and construction phases of the Project.

City staff conducted an arterial sidewalk and curb ramp survey to identify all the remaining sidewalk gaps on arterial streets. The survey revealed five locations with missing sidewalk segments located within one-half mile of school entrances (public and private) where pedestrians walked out on the street, across lawns, dirt, or uneven segments of private property to reach their destinations. Four of the five public schools impacted by these sidewalk gaps are located in disadvantaged communities. The Project will construct over 6,500 linear feet of Americans with Disabilities Act (ADA) accessible sidewalk near nine schools, (five public and four private) closing the sidewalk gaps located within one-half mile of a school entrance.

The following items have been identified to be required:
 Partial acquisition and Temporary Construction Easement (TCE) rights from four parcels at the following locations:

1. 1041 N. Acacia Street (Single Family Residence)

2. 2230 E. La Palma Avenue (Single Family Residence)

3. 2238 E. La Palma Avenue (Single Family Residence)

4. 2930 E. Frontera Street (Fast Great Nursery and Landscape)  Four Preliminary Title Reports (PTRs)
 Four appraisal reports and reviews
 Four offer packages and acquisition negotiations
The City was recently awarded $424,000 in ATP grant funding with no local match required for the right-of-way phase of this Project.

On July 6, 2022, a Request for Proposals for Right-of-Way Acquisition Services for the Project was publicly posted on PlanetBids and the City’s website. On July 29, 2022, five professional firms submitted proposals. In accordance with ATP grant guidelines and the federal and state procurement process, a review committee conducted an evaluation of the proposals and ranked them as follows:

Firm Ranking
Overland, Pacific & Cutler, LLC (OPC) – Long Beach, CA
Epic Land Solutions, Inc. – Torrance, CA
Paragon Partners – Cypress, CA
Regency Right of Way Consulting, LLC. – Pasadena, CA
Security Land & Right of Way Services, Inc. – Orange, CA The review committee concluded that Overland, Pacific & Cutler, LLC (OPC) was the most qualified and responsive firm for this Project. OPC has the ability to perform the tasks outlined in the RFP exhibited by a qualified team, an understanding of the scope of work, their capability of developing innovative or advanced techniques, familiarity with state and federal procedures, their demonstrated technical ability, and company experience.

Pursuant to the ATP grant guidelines, OPC’s sealed cost proposal was opened after they were deemed the most qualified firm to negotiate the cost for their services. The Agreement was negotiated for a base contract fee of $63,015.26, plus a 10% contingency for a total contract not- to-exceed amount of $69,316.79. The cost appears reasonable, and thus OPC is recommended to provide right-of-way acquisition services for the Project.

The right-of-way acquisitions are anticipated to be completed by the summer of 2023.

IMPACT ON THE BUDGET:

Funding is available in the FY 2022/23 Department of Public Works restricted transportation funds budget. A local match is not required for this grant.

Respectfully submitted,
Rudy Emami
