CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 25, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: RESOLUTION ADOPTING UPDATED TITLE VI PLAN
ATTACHMENT (Y/N): YES ITEM # 17
RECOMMENDATION:

That the City Council, by Resolution, approve and adopt the updated City of Anaheim Title VI Plan and authorize its submittal to the California Department of Transportation (Caltrans); and determine its action is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined in Section 15378.

DISCUSSION:

The City of Anaheim adopted the current Title VI Plan in April 2016 in order to comply with federal funding requirements and maintain eligibility for grants. In order to continue with the requirements, the City of Anaheim must periodically update our Title VI Plan. Title VI prohibits the discrimination under any program or activity receiving federal financial assistance by the City of Anaheim.

The updated Title VI Plan would be incorporated into the City’s existing Disability and Civil Rights Plan. Among the topics included in the Title VI Plan is the provision of a Limited English Proficiency (LEP) Plan, established pursuant to and in accordance with Title VI. The LEP plan reiterates that the City will provide the language assistance necessary for meaningful participation in its programs and services to persons who, as a result of national origin, have limited English proficiency. Lastly, the Title VI Plan includes a grievance procedure and form, complying with the Americans with Disabilities Act (ADA) and Title VI requirement that public entities adopt and publish grievance procedures to assure the prompt and equitable resolution of any grievance.

IMPACT ON BUDGET:

There is no budgetary impact as a result of adopting the updated Title VI Plan. The adoption is part of the City’s eligibility for federal funding.

Respectfully submitted,
Rudy Emami
Director of Public Works
