Re: Item3. A RESOLUTIONOFTHEGOVERNINGBOARDOFTHEANAHEIM
HOUSINGAUTHORITYapprovingtheacquisitionof theAnaheimLodgeMotel locatedat837S. BeachBoulevard
DearMayorProTemTrevorO’NeilandCouncilmembers:

TheKennedyCommission (theCommission) isabroadcoalitionof residentsandcommunity organizationsthatadvocatesfor theproductionof homesaffordablefor familiesearninglessthan 27,000annuallyin OrangeCounty. Formedin 2001, theCommissionhasbeensuccessfulin partneringandworkingwithjurisdictionsinOrangeCountyto createeffectivepoliciesthathave ledto theproductionof newhomesaffordableto lowincomeworkingfamilies.

Wesubmitpubliccommentsin supporttheAnaheimHousingAuthorityandtheCityof Anaheimin theacquisitionof theAnaheimLodge (Motel) forthecreationof affordablehousing for ExtremelyLowandVeryLowIncome. Theacquisitionanduseof publiclandsneedsto addresstheacutehousingneedsof low-incomefamiliesstrugglingwiththelackof affordable housingoptions. WeurgetheAgencyandtheCityto clarifythepurposeof theacquisition, the itemstatesthepurposeas “creatingamixed-usedevelopmentinclusiveof varyingaffordable housingopportunitiesutilizingPermanentLocalHousingAllocationand/orLowModerate IncomeHousingAssetfunds”. TheCityandAgencygoalin usingthelocalhousingfundsshould beto leverageadditionalstateandfederalhousingresourcesandcreatedeeperaffordabilityfor thehousingneedsof lowerincomeworkingfamilies.

In theacquisitionof thisproperty, theagencyandcityneedto prioritizethecreationof housing unitsthatare100% affordableto low, verylow, andextremelylowfamilies. 1 Ashighlightedin theCityof Anaheim’slatestHousingElementAnnualProgressReportthat 1wassubmittedto theCaliforniaHousingandCommunityDevelopment, thecityhasadeficitof affordablehousingproduction. Thereportpointsoutthatthecityhasapprovedandpermitted over8,719housingunitsduringthecurrentHousingElementperiodandonly369 (remaining RHNAfor lowerincomeis1,794) havebeenin theaffordabilitylevelof low andverylow households. Thevastmajorityof thehousingunits, 8,350, havebeenapprovedatmoderateand abovemoderate-incomelevels (RHNAin abovemoderatehasbeenexceededbyover300%).

Withthecurrentlackof affordablehousingfor low-incomeworkingfamilies, it isimperative thattheCityof Anaheimprioritizeaffordablehousingonthisdevelopment.

Thankyoufor yourconsideration. Welookforwardto furtherconversations regardingtheuseof agencyownedto increaseaffordablehousingopportunitiesfor thelower incomefamiliesin Anaheim.

Verytrulyyours,

DearMayorPro-TemandCityCouncilMembers,
I wishto addressacoupleof concerns, inreferenceto itemnumbers3 and13onthiscurrentagenda, an ongoingissuefor ourneighborhoodthatwehavebeenlivingwithfor years. Thishasnotbeenaddressedby variousCityof AnaheimDepartmentsfor saidyears, althoughtheywereallawareof it.

I believeit wouldbeagoodthingto for thecityto acquiretheAnaheimLodgeMotelproperty, locatedat837S.

BeachBoulevard, for revitalizationof thiscorridorandto moveforwardwithplansfor housing. However, unlesstheCUPfor saidpropertyisatleastadheredto, I cannotseequalityof lifeimprovingfor thosewho resideintheTwilaReidneighborhood, directlyadjacent (overthewall) to thismotel, andfrankly, alltheother remainingmotelsalongthatstretch, either.

ForyearsTheCityof Anaheimhasacknowledgedthatthisretainingblockwallisnotupto codeandshouldbe addressed, bybuildinganotherwallontheproperty(ies) of saidmotels, whichwouldnotonlybringit upto code, butwouldalsobeadheringto theCUPattachedto eachpropertyof respectivemotel.

ThisCityCouncil, andCityStaffaswell, havethechanceto dotherightthingfor constituents/surrounding neighborsof thisneighborhood. It appearedtheyweredoingtherightthingbyvoting “YES” onApril12, 2022 for theenforcementof this8 footblockto bebuilt. So, whatishappeningto thisblockwallourneighborhood waspromised? Thesaleof theAnaheimLodgeMotelpropertyI wantto addresswithyouinthisrespect. What happensto thiswall? Doesit nowslipthroughanothercrack?
I needto giveyouapictureof whatlifeislikefor theneighborswholiveontheothersideof this4.5 footwall.

It'snotsafefor them. Throughouttheyearsmanyhavetrespassedintheiryards. Alcoholbottles, needles, and othertrashareroutinelytossedintotheiryards. Homeowners/residentscannotenjoytheirbackyards, theway theyshouldbeableto. Onehouse (behindtheCoveredWagon) isfor saleandjustsits. Thosehomesaremuch harderto sellto perspectivebuyers, becauseof thislivingcondition. Oneneighborhadto erectanetalongthe walls, coveringhisbackyard, sohecanprotecthisyardandhaveagardenwithoutdebriscominginfromthe othersideof thewall. Thishasbeenanongoingissuefor thisneighborhoodfor years. And, thecitycontinuesto ignoreit...

So, whenthosehomesalongHaywardStreet (adjacentto motels) sellfor alot less, becauseof thesesafetyand qualityof lifeissues, guesswhoelsesuffers? Everybodyin theneighborhood. Thesehomesareour comparables.
1 NOBODYinthisneighborhoodwins...

I'msureyouwouldn't liketo beplaguedwiththeseissueswhereyoulive. So, nowyouhavethechanceto do therightthingandmakesurethateitherthiscurrentpropertyownerof theAnaheimLodgeMotelbuildsthis wall, ORTheCityof Anaheimbuildsin theprocessof thisacquisition/saleof saidproperty.

Also, it isalsoaconcernthatlanguageshouldbeaddedto theresolutionto makesureanyproductthatAnaheim HousingAuthorityplanfor will bein alignmentwiththeBeachBoulevardSpecificPlan.

I amattachingpicturesof thehousesalongthisstreetandhowtheirlivingconditionlookslivingadjacentto thosemotels. Cypresstreeshavebeenplantedin betweeninsomespotsandyoucanstillseesomewindows throughthemandit doesn't stoppeoplefromthrowingstuffintotheyards. Also, theCoveredWagonproperty hadaneyesoreof abrokenwindow, thathasbeenbrokenfor atleasttwoyears. Thatmotelisdirectlyadjacent to thehousethatjustsitsonthemarket. :-(
Thankyoufor yourconsiderationregardingthesematters.

Sincerely,
TracyUrueta,

DearMayorPro Temand City CouncilMembers,
Backon April12, 2022, myneighborsandI stoodin frontof youto askfor theapprovalto request the AnaheimLodgemotelto constructan 8-foot-highblockwallwhichabutstheresidentialproperties alongthe westernpropertyline (Hayward. Thereweresix Ayesandoneabstention (CouncilDiaz).

We get the wall.... We get the wall....; We finallyLEGALLYget the wall! An 8-footblockwallis legallyrecordedin ResolutionNo 2022-035 andDEV2022-00007. Thatis exactlywhatI shoutedout to all myneighbors, speciallywholive directlybehindthismotelandhavebeennegativelyimpacted for decades.

As of today, the Cityplansto acquirethe AnaheimLodgeunderAnaheim’s HousingAuthority.

While I am100% supportiveof the city’s effortsto purchasethisdilapidatedproperty, thereis still activeopencodecase (COD2022-02383) that hasnot beenresolved- whichis therequirementto buildan 8-footblockwallalongthewesternpropertyline. Eventhoughthe MayorandCouncils Membersapprovedfor this blockwallsix monthsago, thereis still NOWall. Thereis noevidencethat the propertyownershavemadeanyattemptto complywiththe requirementthathasbeenset forth by this city andsupportedby this council.

The CUPof the AnaheimLodgemoteltransferswiththeland, therefore, the AnaheimHousing Authorityshouldbe fully responsibleto buildan 8-footblockwallas requiredunderthetermsof the CUP.

If the purchaseof this propertywasa privatetransaction, wouldn’t the cityrequirethenewbuyerto abideby the termsof the CUP?
1 If the MayorProTemandCouncilMembersdesireto approveitem3 and13 on the agenda, then the city carriesthe full responsibilityto complywiththe currentCUPto buildan 8-footblockwallas approved " Yes" 6-0 on April12, 2022.

Allowmeto backtrackand sharewithyou the historyof the wall.

On, September21,1981, the AnaheimCityPlanningCommissiongrantedthe property837S BeachBlvdto re-classifyfromtheResidential/ AgriculturalZoneto a CommercialZoneuponthe conditionswhichto be a prerequisiteto preservethe safetyandgeneralwelfareof theresidentsof the City. Accordingto ResolutionNo. PC81-200, item #6 stated: " thata 6-foot-highmasonryblock wall shallbe constructed (fromthe highestpointof grade) alongthe westpropertyline." For somereason, the Citystaffshadapprovedthe incorrectheightwhichonly 4.5-foot-high masonrywallfromthe highestpointof gradeinsteadof the 6-footrequirementperResolutionNo. PC 81-200andhasallowedthe propertyto operateout of compliancesince. Dueto thatcriticalmistake, the safetyandthe qualityof our life of thoseof us thatresidenearthe AnaheimLodgehas deteriorated.

I broughtourcomplaintsregardingtrespassing, burglaries, invasionof privacyandunsafein our ownbackyardto the city backin 2010. I’ve hadmeetingswithall CityOfficialsandmultipleCity Departmentheads, pleadingfor helpandnothingchangeduntil April12, 2022.

I understandthatthe Cityhastakena hugestepforwardto protectus by approvingan 8 footblock wall, thereare three (3) optionsthatthis councilcanconsiderpriorto decidingto acquirethe Anaheim Lodgemotel:
1) Enforcethe AnaheimLodgemotelownerto complyto the OpenActiveCodecasepriorto the saleof theproperty. ThecurrentAnaheimLodgeownerbroughtthis propertyin July24, 2014in the amount $2,780,00 dollarsandnowhe plansto salefor $7,600,000dollars. With theearningprofit of $4,820,000in the past8 years, i believehe canaffordto buildthe wall. 2) TheCitycansuggesttheAnaheimHousingAuthorityshouldsubtract/deductthe costto buildan 8-footblockwalloff the final salesprice, thereforethenewowner, AnaheimHousing Authoritycanusethat fundto buildthe wall.
3) TheCityfundsto buildthe wallas requiredunderthe CUP. If theCitycanwaivea quarter of a milliondollarsof TOTtax owedby CoverWagonMotel, thenthe Citycanaffordto buildthis 8- footblockwall, whichhas beenvotedon andpromisedto us, the residentsin WestAnaheim.

This yearmarksa 13-yearbattleof fightingthe city andthe AnaheimLodgeof the wallissue. This errorwascausedby a memberof city staffbackin 1981. Andin 2014, whenthe propertychangedto2 newowner, Mr. MahendraAhir, the Citystaffsrecognizedthe violationof the heightof the wall, but againdecidednot to enforcea interpretationof the CUP's blockwallheightrequirement. I am extremelytired, andI hopethe MayorProTemandCouncilMemberswill honoryourvotefromApril 12, 2022and continuesupportour requestto providean 8-footblockwallViathosethreeoptions above.

Makingthe decisionto approvethe acquisitionof the AnaheimLodgeMotelwill stronglyreflect yourleadership, yourintegrity, yourcommitment, yourhonesty, yourcourage, andyourconfidenceto standup for the right of yourconstituents.
