CITY COUNCIL AGENDA REPORT
City of Anaheim

OFFICE OF THE CITY CLERK
DATE: NOVEMBER 15, 2022
FROM: OFFICES OF THE CITY CLERK AND CITY ATTORNEY
SUBJECT: AMENDMENTS TO THE CITY’S CONFLICT OF INTEREST
CODE
ATTACHMENT (Y/N): YES ITEM # 27
RECOMMENDATION:

That the City Council, as the Code Reviewing Body pursuant to the Political Reform Act, by Resolution, approve amendments to the Conflict of Interest Code (“Code”) for the City and various City Agencies.

DISCUSSION:

The City Council is the Code Reviewing Body for the City of Anaheim. In addition, the City Council is the Code Reviewing Body for the Successor Agency to the Anaheim Redevelopment Agency, the Anaheim Housing Authority, the Anaheim Public Financing Authority, the Industrial Development Authority of the City of Anaheim, the Anaheim Public Improvement Corporation, and the Anaheim Housing and Public Improvements Authority (collectively referred to as the “Agencies”).

The Political Reform Act requires all local agencies to conduct a review of their conflict of interest codes and present any amendments, if necessary, to the reviewing Board, for approval. The City Council last amended its Code on November 24, 2020 by Resolution No. 2020-138.

The recommended changes reflect modifications made to city position titles, obsolete positions, or added positions, as well as reflecting the creation of two separate departments: 1) Housing and Community Development Department, and 2) Economic Development Department. Each City department, the City Clerk, and the City Attorney have reviewed and approved the recommended revisions. In addition, the Oversight Board of the Successor Agency to the Anaheim Redevelopment Agency was removed, due to the creation of the Orange Countywide Oversight Board by California Senate Bill 107 and pursuant to California Health and Safety Code § 34179(j), which oversees the 25 Successor Agencies in Orange County. A redline copy of the designated positions is attached for reference.

The disclosure categories do not require any revisions, but are attached for reference as Appendix A to the Resolution.
