CITY COUNCIL AGENDA REPORT
City of Anaheim

PUBLIC UTILITIES DEPARTMENT
DATE: NOVEMBER 15, 2022
FROM: PUBLIC UTILITIES DEPARTMENT
SUBJECT: APPROVAL OF SAFETY CONSULTING SERVICES

AGREEMENTS
ATTACHMENT (Y/N): YES ITEM # 19
RECOMMENDATION:

That the City Council, by Motion:
1) Approve the Safety Consulting Services Agreement (Agreement) for as-needed safety services and authorize the Public Utilities General Manager, on behalf of the City of Anaheim (City), to execute the Agreement separately with the following four consultants prequalified for a five-year term with up to two one- year extensions as needed to complete ongoing projects: A-Tech Consulting, Inc.; ALTA Environmental, L.P., an NV5 Company; Global Environmental Network, Inc.; TRC Solutions, Inc.; and such other safety services consultants that may be prequalified during the term of the Agreement; 2) Approve a not-to-exceed contract amount of $500,000 per consultant for the entire five-year term of the Agreement and any term extensions, with authorization for extra work in an amount per work order not to exceed $10,000 or 15% of cost, whichever is greater;
3) Authorize the Public Utilities General Manager, or designee, on behalf of the City, to take any and all actions as are necessary to implement and administer the Agreement; and
4) Authorize de minimis changes that do not substantially change the terms and conditions of the Agreement, as determined by the City Attorney.

DISCUSSION:

At its meeting on October 26, 2022, the Public Utilities Board (PUB) recommended that City Council approve these actions.

Anaheim Public Utilities’ (APU) electric and water operations require working in hazardous conditions, and ensuring employee and customer safety is paramount. APU is therefore seeking prequalified consultants to support training and compliance with numerous federal and state safety laws and regulations. The scope of work that must be undertaken to ensure compliance with these requirements is diverse, and providing it in a Approval of Safety Consulting Services Agreements

timely and professional manner often requires the assistance of technical consultants with specialized education, certifications, and experience.

Safety compliance activities include diverse tasks such as conducting training for APU staff on electric arc flash protection, fall rescue, excavation safety, and other specialized topics; conducting safety audits and inspection of APU equipment and facilities; implementing industrial hygiene studies for chemical and noise exposure; and providing technical expertise to support the development of safety procedures and policies. Due to the varied and time-sensitive nature of the work, APU staff seeks the prequalification and retention of multiple consultants that will be available for work on short notice. This will ensure that qualified technical expertise and support will be available promptly when needed to respond to critical safety projects.

A similar process for prequalifying safety services firms was previously approved by the City Council in November 2019, and six project awards have been issued to date, with current agreements set to expire in November 2022.

On July 28, 2022, a Request for Qualifications (RFQ) for professional services was issued for as-needed safety services through the City’s online procurement portal. The RFQ requested safety services under two Service Groups, with activities that are delineated in Exhibit A of the Agreement, and summarized as follows:

Service Group 1: Training
 Trenching and shoring
 Confined space entry
 Ladder safety
 Traffic control
 Welding/cutting/brazing safety
 High voltage safety
 Hoisting and rigging safety
 Fall protection
 Emergency action plan/disaster
preparedness
 Lockout/Tagout
 Arc flash
 Fire extinguisher operation
 Sling user
 Heat illness prevention
 Asbestos awareness, operation and
maintenance, and asbestos cement
pipe worker
 Defensive driver
Service Group 2: Hazardous Materials Management / Facility Compliance  Industrial hygiene
 Facility and jobsite inspections
 Arc flash analysis
 Ergonomic evaluations
 Safety policy review
Consultants were allowed to request prequalification in one or both Service Groups.

Responses to the RFQ were received from five consultants and were evaluated in accordance with the qualification-based selection procurement required by City Council Policy 4.1 to determine the highest ranked proposals. The evaluation criteria included the ability of each consultant to perform the specific tasks outlined in the RFQ, the qualifications of specific individuals who will work on particular projects, the extent of involvement by key personnel who will be committed to certain types of projects, the demonstrated record of success by the consultant on similar work previously performed, the particular methods and techniques to be employed by the consultant on a given type of project or situation, and the reasonableness of the fee schedule submitted for safety Approval of Safety Consulting Services Agreements

consulting work. Upon evaluation of the proposals, the following consultants best met the service requirements of the RFQ and are recommended for prequalification in accordance with Council Policy 4.1:

Service Group 1: Training
 A-Tech Consulting, Inc. (Orange, CA)
 Global Environmental Network, Inc. (Santa Ana, CA)
 TRC Solutions, Inc. (Irvine, CA)
Service Group 2: Hazardous Materials Management / Facility Compliance  A-Tech Consulting, Inc. (Orange, CA)
 ALTA Environmental, L.P., an NV5 Company (Long Beach, CA)  Global Environmental Network, Inc. (Santa Ana, CA)
 TRC Solutions, Inc. (Irvine, CA)
The recommended consultants all have extensive technical experience in their respective areas of expertise and hold the proper licensing and insurance to perform the required safety services in the State of California. The proposals demonstrated that the recommended consultants have experience working on projects for other California municipalities and utilities, such as Pasadena Water and Power, City of Huntington Beach, Los Angeles Department of Water and Power, and City of Roseville Electric. The not-to- exceed contract amount for each consultant will be $500,000 over the 5-year term of the Agreement and any extensions, plus a limited amount for extra services when needed to complete a work order.

Prequalification does not guarantee that work will be awarded to the consultants. When safety consulting services under the Agreement are required, the prequalified safety consultants will be invited to respond to a Request for Work Order Proposal outlining the detailed scope of work, fee schedule, and availability for work. Projects will be awarded to the highest rated consultant deemed best able to complete the scope of work within the required schedule at a reasonable cost, in accordance with Council Policy 4.1. As with other prequalified consulting services, a quarterly report will be prepared for the Public Utilities Board’s review of selection of consultants and status of services provided.

IMPACT ON BUDGET:

There is no budgetary impact resulting from prequalifying the contractors in the Agreement. Safety consulting services ultimately awarded through the Agreement are included in APU’s Fiscal Year 2022/23 budget, and funds for subsequent years are subject to City Council budget approval.

Respectfully submitted,
Dukku Lee
Public Utilities General Manager
