RECOMMENDATION:
That the City Council, by Resolution, vacate, pursuant to California Streets and Highways Code section 8330 et seq., a public utility easement previously used for Anaheim Public Utilities facilities, as described in Exhibit “A” and “B” of the Resolution (Attachment 1 hereto) and further depicted in the Property Sketch (Attachment 2 hereto).
DISCUSSION:
The applicant has requested that the City vacate the existing easement to clear title to their land.
The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the easement has been superseded by relocation and there are no other public facilities located within the easement. The request has been reviewed by Anaheim Public Utilities and there are no objections to the proposed vacation.
IMPACT ON BUDGET:
City Council Policy No. 5.5 waives the requirements of compensation to the City when, as here, the abandonment meets the criteria for a summary vacation of an unused easement.
Therefore, the City has no compensable interest in the easement.
