DISCUSSION:
In December 2021, City Council adopted the inaugural memoranda of understanding (MOUs) with the American Federation of State, County, and Municipal Employees (AFSCME). Concurrent with the adoption of the new MOUs, City Council adopted changes to the Personnel Rules and Policies Covering Non-Represented Full-Time and Part-Time Employees (Personnel Rules) necessary to reflect that classifications formerly unrepresented were now represented by AFSCME and subject to the terms and conditions of the MOUs between AFSCME and the City of Anaheim. The remaining Adoption of Changes to Personnel Rules and Policies for Unrepresented Employees and Introduction of an Ordinance to Amend Chapter 1.05 of the Anaheim Municipal Code
November 15, 2022
Full-Time Non-Represented classifications include Executive classifications, a small number of classifications with some level of access to or responsibility for employee and labor relations matters in the City Attorney Office and Human Resources Department; two Police Management and three Fire Management classifications, and Ambulance Operator. Part-Time classifications include a number of classifications typically filled in a seasonal, limited term, or temporary basis as well as Part-Time classifications directly related to Full-Time represented classifications.
In December 2021, staff proposed minimally necessary amendments to the Personnel Rules with the intention of returning with additional amendments to complete the process of carving out references to AFSCME represented classifications and specific rules related thereto. Staff has now completed a more extensive review of the Personnel Rules with a goal to bring greater clarity, fully incorporate the amendments made in 2021, remove any remaining references to AFSCME represented classifications, and make other appropriate updates. In addition to these “clean up” type of amendments, also included are recommended changes to accomplish the following:
1. Adjust pay and vacation accruals for Non-Represented Fire Management employees equivalent to changes recently negotiated with the employees under their supervision represented by the Anaheim Firefighters Association.
2. Adjust pay for Non-Represented Part-Time Fire Cadets and Ambulance Operators consistent with changes adopted by City Council on November 1, 2022 for Police Cadets.
3. Adjust pay for Non-Represented Part-Time classifications necessary to comply with California minimum wage law.
4. Deletion of Non-Represented classifications from the position classification plan within the City’s personnel system.
5. Move the Chief Policy Advisor to the Mayor classification from AFSCME representation and return it to Non-Represented status. This change requires the concurrent adoption of the Letter of Understanding with AFSCME agreeing the change.
In conjunction with changes to the Personnel Rules, staff proposes changes to Anaheim Municipal Code Chapter 1.05 Personnel System. Proposed changes include updating appropriate references to the Anaheim City Charter and Administrative Regulations as well as clarification of employees authorized to access and use state and local criminal information for the purposes of making employment, licensing, or certification decisions. The majority of the proposed changes are within subsection .030 (Scope).
These include regrouping classes of employees deemed exempt from the classified service, eliminating references to consultants and to classifications recommended for deletion, and specifying the inclusion of the classifications of Chief Policy Advisor to the Mayor, Senior Policy Aide, City Council Aide II and City Council Aide I, Administrative Intern II, Administrative Intern I, and Part-Time Ambulance Operator in the exempt service.
Adoption of Changes to Personnel Rules and Policies for Unrepresented Employees and Introduction of an Ordinance to Amend Chapter 1.05 of the Anaheim Municipal Code
November 15, 2022
IMPACT ON BUDGET:
The General Fund impact of the proposed changes is estimated to be $448,110 in Fiscal Year 2022/2023 and $2,460,100 through Fiscal Year 2024/2025, of which 100% is General Fund. Funding will come from additional revenues or other expenditure savings by the departments. The Fire Department’s FY 2022/2023 General Fund budget will be amended by $448,110 to support this recommendation.
Respectfully submitted,
Linda N. Andal
Human Resources Director
