HUMAN RESOURCES DEPARTMENT
DATE: NOVEMBER 15, 2022
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: ADOPTION OF A MEMORANDUM OF UNDERSTANDING

BETWEEN THE CITY OF ANAHEIM AND THE ANAHEIM
FIREFIGHTERS ASSOCIATION, LOCAL NO. 2899
ATTACHMENT (Y/N): YES ITEM # 28
RECOMMENDATION:

That the City Council, take the following actions:

1. By Resolution, adopt a Memorandum of Understanding establishing the terms and conditions of employment for classifications in the Anaheim Firefighters Association, Local No. 2899, effective June 24, 2022 through June 19, 2025; and

2. By Motion, amend the FY2022/23 budget by $3,578,000.

DISCUSSION:

The Memorandum of Understanding (MOU) between the City of Anaheim and the Anaheim Firefighters Association, Local No. 2899 (AFA), expired on June 23, 2022.

Since June, the City’s labor negotiator has worked under City Council authority to meet and confer with the AFA. The MOU presented for City Council consideration reflects the tentative agreement reached with the AFA on September 30, 2022 and subsequently ratified by the AFA members on October 22, 2022.

The AFA represents approximately 209 employees in classifications including Firefighter, Fire Engineer, and Fire Captain. Major provisions of the agreement include:
 Term of three years from June 24, 2022 through June 19, 2025;  A total 10.5% wage increase over the term of the agreement with the first 3.5% adjustment retroactive to June 24, 2022;
 A one-time, lump sum, non-pensionable bonus of $5,000;  Increase specialty pays for the following assignments to 7.5% of the tenth step of the Firefighter I classification: Urban Search & Rescue, Training Company, and SWAT;
 Increase the administrative differential pay of 40-hour employees to 10% of base pay;
 Increase the premium for temporary upgrade of employees to 7.5% of base pay for all time worked in a higher job classification if they are assigned to work in the higher job classification for a period of four working hours or longer; Adoption of Memorandum of Understanding between the City of Anaheim and the AFA November 15, 2022

 Effective June 24, 2022, establish the City contribution of 1% of base pay to employees’ Retirement Health Savings accounts on a bi-weekly basis; The City’s contribution will increase to three percent 3% of base pay effective June 23, 2023;
 Increase paid leave accruals for 56-hour employees upon completion of 19 years of continuous, full-time service by one hour for each complete bi-weekly pay period for a total of 18.5 hours;
 Establish a new tier of paid leave accruals for 56-hour employees upon completion of 24 years of continuous, full-time service at the rate of 19.5 hours for each complete bi-weekly pay period; and
 For parity purposes with paid leave accruals, increase vacation accruals for 40- hour employees upon completion of 19 years of continuous, full-time service by

0.75 hours for each complete bi-weekly pay period for a total of ten hours; similarly, increase vacation accruals upon completion of 24 years of continuous, full-time service by three-quarter 0.75 hours for a total of 11 hours for each complete bi-weekly pay period.

The tentative agreement also provides clarifying or new language on other issues of employment related to staffing levels, reimbursement for travel expenses, and other administrative provisions, including a comprehensive language cleanup. A red-line copy of the MOU reflecting the agreed changes is included with this report.

IMPACT ON BUDGET:

The General Fund impact of the contract is estimated to be $3,578,000 in Fiscal Year 2022/2023 and $16,021,000 over the three-year term of the agreement, of which nearly 100% is General Fund. Funding will come from additional revenues or other expenditure savings by the department. The Fire Department’s FY 2022/2023 budget will be amended by $3,578,000 to support this recommendation.

Respectfully submitted,
Linda N. Andal
Human Resources Director
