SUBJECT: ANNUAL REVIEW OF DEVELOPMENT AGREEMENT NO.
2021-00001 FOR 2323 WEST BROADWAY (MELIA TOWNES
AT BROADWAY)
ATTACHMENT (Y/N): YES ITEM # 06
RECOMMENDATION:
That the City Council, by Motion, determine, on the basis of the evidence submitted by Melia Homes, Inc., that the property owner has complied in good faith with the terms and conditions of Development Agreement No. 2021-00001 for the 2022 review period for the 2323 West Broadway townhome project (Melia Townes at Broadway).
DISCUSSION:
A Development Agreement is a contract between the City and property owner that provides certainty to the developer that the approved project will be exempt from future changes to zoning laws and requires the developer to provide benefits to the City in exchange for that certainty. On October 5, 2021, the City of Anaheim and Melia Homes, Inc. executed a Development Agreement (Attachment 2) associated with a townhome development consisting of 112 units at 2323 West Broadway. The development agreement provides surety for the developer and includes a voluntary financial contribution in the amount of $112,000 to support the City’s affordable housing programs and projects which would be used at the City’s discretion to support affordable housing programs and projects.
Pursuant to the Development Agreement, the City Council is required to determine annually if the property owner has complied in good faith with the terms and conditions of the Development Agreement. Demonstration of good faith compliance includes conformance with all terms and schedules set forth in the Development Agreement. If the Council finds that the property owners have demonstrated good faith compliance, the review for that period is complete.
Annual Review of Development Agreement No. 2021-00001
November 15, 2022
The Development Agreement contains specific developer obligations. Attachment 1 is an Annual Review Letter submitted by the property owner outlining the status of said obligations. The project development has commenced with 33 permits issued to date. Four of those permits are for models which are scheduled to open February 25, 2023. The remaining permits are for the first phase of production units scheduled for occupancy in March 2023. As of the date of this report, Melia Homes has fulfilled their obligation in making the first of two voluntary contributions in the amount of $56,000, with the second contribution due on or before the issuance of any certificate of occupancy or temporary certificate of occupancy, or a transfer of the property to another entity.
Staff has reviewed the terms of the Development Agreement and has determined that the property owner complies with all applicable terms for this review period. Staff recommends that the City Council determine that the property owner has complied in good faith with the terms and conditions of the Development Agreement for this review period.
IMPACT ON BUDGET:
There is no budgetary impact. Melia Homes, Inc. pays for the processing costs associated with this annual review.
Respectfully submitted,
Ted White
Planning and Building Director
