CITY COUNCIL AGENDA REPORT
City of Anaheim

HUMAN RESOURCES DEPARTMENT
DATE: DECEMBER 20, 2022
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: ADOPTION OF A LETTER OF UNDERSTANDING BETWEEN

THE INTERNATIONAL BROTHERHOOD OF ELECTRICAL
WORKERS, LOCAL 47 AND THE CITY OF ANAHEIM
ATTACHMENT (Y/N): YES ITEM # 25
RECOMMENDATION:

That the City Council, by Resolution, adopt the Letter of Understanding (LOU) between the International Brotherhood of Electrical Workers, Local 47 and the City of Anaheim dated December 12, 2022 (LOU).

DISCUSSION:

The International Brotherhood of Electrical Workers, Local 47 (“IBEW”) and the City of Anaheim (“City”) entered into a Memorandum of Understanding for the term July 1, 2020 through December 31, 2022 (“MOU”). The Parties have been addressing concerns regarding the interpretation and application of the provisions of the agreement concerning holiday pay, specifically those holidays that fall on a Saturday or Sunday (“weekends”) and a separate weekday is observed in lieu of the holiday.

Due to the nature of work provided by employees represented by the IBEW, employees in certain classifications are required to work on days recognized by the City as holidays as well as on days observed in lieu of weekend holidays. The existing language in the MOU concerning pay for employees required to work on such days has been interpreted differently by operating departments. Given that the interpretation and application of holiday pay has not been applied consistently, the City met and conferred with the IBEW to reach a compromise and amend the language to ensure consistent interpretation and application of the MOU for the benefit of employees scheduled to work on weekends and/or a separate weekday that is observed in lieu of the holiday. The attached Letter of Understanding sets forth the compromise and will become a part of the MOU.

IMPACT ON BUDGET:

The impact on the budget is minimal - the MOU recognizes ten holidays and in calendar year 2023, only one holiday (January 1) falls on a weekend (Sunday) and is observed on Monday, January 2, 2023. Costs associated with the LOU will be absorbed by existing Public Utilities and Convention, Sports and Entertainment Department budgets.

Respectfully submitted,
Linda N. Andal
Human Resources Director
