CITY COUNCIL AGENDA REPORT
City of Anaheim

HUMAN RESOURCES DEPARTMENT
DATE: DECEMBER 20, 2022
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: ADOPTION OF A MEMORANDUM OF UNDERSTANDING

BETWEEN THE CITY OF ANAHEIM AND THE SERVICE
EMPLOYEES’ INTERNATIONAL UNION, UNITED SERVICE

WORKERS WEST
ATTACHMENT (Y/N): YES ITEM # 24
RECOMMENDATION:

That the City Council, by Resolution, adopt a Memorandum of Understanding establishing the terms and conditions of employment for classifications represented by the Service Employees’ International Union, United Service Workers West, effective January 7, 2022 through December 21, 2023.

DISCUSSION:

The Memorandum of Understanding (MOU) between the City of Anaheim and the Service Employees’ International Union, United Service Workers West (SEIU-USWW), expired on January 6, 2022. The City’s labor negotiator has worked under City Council authority to meet and confer with SEIU-USWW. The MOU presented for City Council consideration reflects the tentative agreement reached with SEIU-USWW on November 27, 2022 and subsequently ratified by SEIU-USWW members.

SEIU-USWW represents approximately 231 employees in classifications including Alteration Worker, Cleaner/Setup Worker, Usher, and Nurse that support the Anaheim Convention, Sports and Entertainment Department. The previous MOU expired during the pandemic (January 2021), and in consideration of the economic climate, this bargaining unit agreed to a one year term that maintained salary and benefits at status quo while only adjusting wages to comply with the 2022 State minimum wage, resulting in the flattening of pay scales for some classifications.

The proposed MOU includes a term from January 7, 2022 (the date the prior agreement expired) through December 21, 2023. The pay adjustments, effective December 23, 2022, take in consideration current market rates that accurately reflect the duties and responsibilities for the classifications. The starting pay rate is set competitively above the 2023 State minimum wage at $17.00/hour with a 3% differential between steps. The tentative agreement also incorporates clarifying language of an approved Letter of Understanding between the parties on the work hours eligible for graveyard differential Adoption of Memorandum of Understanding between the City of Anaheim and SEIU-USWW December 20, 2022

pay as well as other minor language cleanup. A red-line copy of the MOU reflecting the agreed changes is included with this report.

IMPACT ON BUDGET:

The impact of the contract is estimated to be $487,000 in Fiscal Year 2022/2023 and $972,000 over the term of the agreement, of which 100% is from the Convention Center Enterprise Fund budget. The department has sufficient appropriation to absorb the increase.

Respectfully submitted,
Linda N. Andal
Human Resources Director
