CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 20, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: VACATION/ABANDONMENT VACATING A PORTION OF

DOUGLASS ROAD BETWEEN KATELLA AVENUE AND

CERRITOS AVENUE IN CONJUNCTION WITH DEVELOPMENT
AGREEMENT NO. 2020-00004 (ABA2021-00412)
ATTACHMENT (Y/N): YES ITEM # 35
RECOMMENDATION:

That the City Council, following a public hearing:

1. By Resolution, approve the proposed vacation/abandonment vacating a portion of Douglass Road between Katella Avenue and Cerritos Avenue in conjunction with Development Agreement No. 2020-00004;

2. By Motion, authorize the Public Works Director to execute Quitclaim Deeds, if necessary, relinquishing property interest in existing public facilities lying within the portion of Douglass Road proposed for abandonment; and

3. By Motion, authorize and direct the City Clerk to cause a certified copy of the Resolution to be recorded in the Office of the Recorder of the County of Orange upon satisfaction of those conditions required by DEV2020-00004 and as directed by the Public Works Director or his designee.

DISCUSSION:

This abandonment has been requested by the applicants/owners, Anaheim Real Estate Partners LLC (AREP), in order to assemble the proposed abandoned public right-of-way with adjacent properties to serve a new development. The new development, commonly known as OCVibe, includes a mix of entertainment, office, retail, restaurant, and residential uses. On October 4, 2022, the Anaheim City Council approved Development Agreement No. 2020-00004 (DEV2020-00004), which discusses the abandonment of a portion of Douglass Road between Katella Avenue and Cerritos Avenue. In addition to abandoning a portion of Douglass Road, the OCVibe development proposes roadway modifications that enhance circulation and change Anaheim’s roadway network.

Through these modifications and changes, this portion of Douglass Road will not be required for public right-of-way and therefore considered excess and unnecessary for present or prospective public use.

Changes to Anaheim’s roadway network require Orange County Transportation Authority (OCTA) approval through an amendment to the Master Plan of Arterial Highways (MPAH). On October 3, 2022, the OCTA Regional Planning and Highways Vacation/Abandonment vacating a portion of Douglass Road between Katella Avenue and Cerritos Avenue in conjunction with Development Agreement No. 2020-00004 (ABA2021-00412)

Committee conditionally approved an amendment to the MPAH. The amendment removes the portion of Douglass Road proposed for abandonment and adds a new public street between Katella Avenue and Ball Road, proposed to be named River Road.

The above amendment to the MPAH is contemplated in DEV2020-00004, but it further stipulates that the abandonment of Douglass Road requires that River Road between Katella Avenue and Ball Road be dedicated, constructed, operated, and accepted by Anaheim. The OCVibe development will also construct and maintain private roadways with public access easements dedicated to the city of Anaheim. The dedication of public access easements over the private roadways will also ensure that all properties have access to public streets.

In addition to the conditions stipulated by OCTA and the authority contained in DEV2020- 00004 any remaining public easement rights within the discussed portion of Douglass Road shall be secured by an easement deed and recorded concurrently with the vacation/abandonment resolution.

This item intends to establish City Council support and approval for this proposed abandonment within the context of DEV2020-00004, the conditional approval of the MPAH, public and private access rights, and public utility rights.

Based on the foregoing, the right-of-way under consideration for abandonment shall become unnecessary for public access and public street use within the contemplation of Section 8324 (b) of the Streets and Highways Code and is exempt from the Surplus Land Act.

IMPACT ON BUDGET:

There is no budgetary impact.

Respectfully submitted,
Rudy Emami
Director of Public Works
