CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 20, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: JOINT PARTICIPATION AGREEMENT WITH THE CITY OF

BUENA PARK FOR THE KNOTT AVENUE REHABILITATION

FROM BALL ROAD TO ORANGE AVENUE PROJECT AND

DETERMINE THE PROJECT IS EXEMPT FROM CEQA
ATTACHMENT (Y/N): YES ITEM # 22
RECOMMENDATION:

That the City Council, by Motion:
1) Approve the Joint Participation Agreement (Agreement) between the City of Anaheim (Anaheim) and the City of Buena Park (Buena Park) for the design, construction, and administration of the Knott Avenue Rehabilitation from Ball Road to Orange Avenue Project (Project); and
2) Authorize and direct the Director of Public Works or designee, on behalf of the Anaheim, to execute the Agreement and any related documents, and to take any and all actions as necessary to implement and administer the Agreement; and 3) Determine that the Project is Categorically Exempt under the California Environmental Quality Act (CEQA).

DISCUSSION:

The City of Anaheim (Anaheim) plans to rehabilitate the pavement on Knott Avenue from Ball Road to Orange Avenue (Anaheim Project). Since only a small portion of Knott Avenue between Mount Waterman Drive and Mungall Drive lies within the limits of the City of Buena Park (Buena Park), it will be more efficient and convenient to the traveling public if Anaheim, at the same time as it undertakes the Anaheim Project, also takes the lead in rehabilitating the portion of the pavement that lies within Buena Park.

The Project consists of the removal and replacement of deteriorated asphalt pavement, curb and gutter, sidewalk, driveway approaches, construction of new ADA compliant ramps, and new striping and pavement legends.

The total Project cost is estimated at $1,816,286, which includes a contingency, inspection, and staff time. Buena Park’s pro-rata share is estimated at $62,727 or around

3.5% of the total Project cost. The contingency will account for, if necessary, additional or unforeseen work. The Project’s final cost shall be based on the actual cost upon Joint Participation Agreement with the City of Buena Park for the Knott Avenue Rehabilitation from Ball Road to Orange Avenue and CEQA Determination

completion. Buena Park will reimburse Anaheim its pro-rata share of the actual costs within 45 days of being invoiced. Anaheim will receive $1,037,763 in federal funding for its portion of the Project costs through the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) Program, which is being administered by the California Department of Transportation (Caltrans).

The Agreement between Anaheim and Buena Park outlines the respective roles and responsibilities for the Project and stipulates that Anaheim will be the lead agency for the design, construction, and administration of the Project.

Construction is anticipated to start during the spring of 2023 and be completed during the summer of 2023.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk.

IMPACT ON BUDGET:

Adequate funding is available from restricted transportation funds in the Department of Public Works FY 2022/23 budget.

Respectfully submitted,
Rudy Emami
Director of Public Works
