CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 20, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SECOND AMENDMENT TO COOPERATIVE AGREEMENT
NO. MA-080-19010444 WITH THE COUNTY OF ORANGE FOR
FUNDING, DESIGN, AND CONSTRUCTION FOR THE
BROOKHURST STREET WIDENING, PHASE 2
ATTACHMENT (Y/N): YES ITEM # 23
RECOMMENDATION:
That the City Council, by Motion:
1) Approve Amendment No. 2 (Amendment) to Cooperative Agreement No.
MA-080-19010444 with the County of Orange for the Brookhurst Street Widening, Phase 2 Project (Project) increasing the County’s contribution by $1,970,000 for a total of $5,180,000 with Anaheim’s pro-rata share of the Project now estimated at $1,580,000; and
2) Authorize and direct the Director of Public Works or designee, on behalf of the City of Anaheim, to execute Amendment No. 2 and any related documents, and to take any and all actions as necessary to implement and administer the Amendment.
DISCUSSION:
Brookhurst Street is designated as a six lane Major Arterial Highway on the Orange County Transportation Authority (OCTA) Master Plan of Arterial Highways. In June 2015, the City of Anaheim (City) widened Brookhurst Street from Ball Road to Katella Avenue from four to six lanes, (with the exception of the segment from Guinida Lane to Cerritos Avenue which was widened to five lanes) as part of the Brookhurst Street Widening, Phase 1.
The County of Orange (County) has requested that the City widen Brookhurst Street from Guinida Lane to Cerritos Avenue (Project) to add a third southbound lane within the County limits due to the need to accommodate the high volume of 31,000 vehicles per day per OCTA's 2016 Traffic Flow Map.
In 2018, the County and the City entered into Cooperative Agreement No. MA-080- 19010444 in which the City agreed to be the lead agency for the design, right-of-way engineering, and construction of the Project and that the County would acquire the right- of-way and pay the actual costs and expenses of the Project within the existing County Second Amendment to Cooperative Agreement No. MA-080-19010444 with the County of Orange for Funding, Design, and Construction for the Brookhurst Street Widening, Phase 2

right-of-way from County Road Funds. The County agreed to reimburse the City during the design and construction phases.
On January 26, 2021, the City Council approved Amendment No. 1 to the Cooperative Agreement increasing the County and City’s contributions to accommodate improvements not previously accounted for in the original scope of work. In addition, Amendment No. 1 included language to allow the County to be the lead to perform the boundary adjustment along the west side of Brookhurst Street from north of Guinida Lane to Cerritos Avenue in order to have the street and parkway in its entirety within the City’s jurisdiction, and it also changed the term of the Agreement.
Amendment No. 2 will increase the County’s total contribution by $1,970,000 for a total cost of $5,180,000 for all the proposed improvements within the existing County right-of-way. The County’s budget increase will include additional right-of-way acquisition costs and is needed to reflect the increase in the market’s current construction costs.
Amendment No. 2 will also increase the City’s pro-rata share by $860,000 for a total cost of $1,580,000 to accommodate added improvements within the City’s right-of-way including additional pavement restoration and to reflect the market’s current construction costs, which have greatly escalated during the past two years. The Project’s final costs shall be based on the actual costs upon completion.
Additionally, the County and City desire to eliminate the requirement to declare Brookhurst Street as a County Highway since it is not needed for the County to acquire the required right- of-way for the Project.
The Project is currently in the design phase and approximately 75% complete. The County is currently in the right-of-way acquisition process negotiating with the affected property owners.
Construction is anticipated to start during FY 2023/24 and is expected to last approximately nine (9) months.
IMPACT ON BUDGET:
Adequate funding is available in Anaheim Public Utilities’ restricted Water Utility Fund and the Department of Public Works’ Gas Tax Transportation Fund FY 2022/23 budgets.
