CITY COUNCIL AGENDA REPORT
HUMAN RESOURCES DEPARTMENT
DATE: JANUARY 24, 2023
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: APPROVAL OF A RETIRED ANNUITANT PRIOR TO THE
180- DAY WAITING PERIOD TO FILL A CRITICALLY NEEDED
POSITION IN THE ANAHEIM POLICE DEPARTMENT
ATTACHMENT (Y/N): YES ITEM # 11
RECOMMENDATION:
That the City Council, by Resolution, waive the 180-day waiting period and approve the appointment of Vincent Delgado, Police Investigation Technician, as a retired annuitant, determining the critical need of the position within the Anaheim Police Department.
DISCUSSION:
Pursuant to the California Public Employees’ Pension Reform Act of 2013 (“PEPRA”), a person who retires from a public employer may serve without reinstatement from retirement or loss or interruption of benefits for up to 960 hours in a fiscal year. The retired person shall not be eligible to be employed for a period of 180 days following the date of retirement unless an employer certifies the nature of employment, that the appointment is necessary to fill a critically needed position before 180 days has passed, and the appointment has been approved by the governing body of the employer in a public meeting.
Police Investigation Technician Vincent Delgado retired on December 30, 2022. Mr.
Delgado was responsible for conducting polygraph examinations for the Anaheim Police Department and the Anaheim Fire and Rescue Department. The City recently recruited for the position and the incumbent requires additional training from Mr.
Delgado for at least six (6) months. Based on the current staffing levels and expected recruitments in both Police and Fire, there is an immediate need for an experienced polygraph examiner to assist in training the new incumbent as well as ensuring the hiring process is not interrupted.
Mr. Delgado served the City of Anaheim as a Police Polygraph Examiner and Police Investigation Technician for over 30 years. His knowledge and experience is necessary to ensure the transition of this critical role in the City’s hiring process. 201 S. Anaheim Blvd.

Approval of a Retired Annuitant prior to the 180-day waiting period to fill a critically needed position in APD January 24, 2023
Approval of the resolution will authorize the rehire of Vincent Delgado as a retired annuitant to serve in the position of Police Investigation Technician, at his retired rate of pay for a period not to exceed one year and an annual maximum number of 960 work hours. This position will bridge the period necessary for the City to meet minimum staffing needs, decrease mandatory overtime, and provide the experience necessary to assist with the training, mentoring, and development of a new polygraph examiner.
IMPACT ON BUDGET:
Sufficient funds are available in the Police Department’s FY 22/23 budget.
Respectfully submitted, Concurred by,
Linda N. Andal Jorge Cisneros
