CITY COUNCIL AGENDA REPORT
City of Anaheim

OFFICES OF CITY MANAGER AND CITY CLERK
DATE: JANUARY 24, 2023
FROM: OFFICES OF THE CITY MANAGER AND CITY CLERK
SUBJECT: APPOINTMENT TO FILL DISTRICT 4 COUNCIL MEMBER

VACANCY
ATTACHMENT (Y/N): YES ITEM # 13
ACTION:

That the City Council, through the nomination and appointment process, make an appointment to fill the District 4 City Council vacancy.

DISCUSSION:

Former Council Member Avelino Valencia was elected at the November 8, 2022 General Municipal Election to the California State Assembly District 68 seat and resigned from his District 4 City Council Member seat on December 4, 2022. Pursuant to Section 503 of the City Charter of the City of Anaheim, a vacancy on the City Council, from whatever cause arising, shall be filled by appointment by the City Council, such appointee shall hold the office until the first Tuesday following the next General Municipal Election, scheduled for November 5, 2024, and until his or her successor qualifies. In the event the City Council fails to fill the vacancy by appointment within sixty (60) days, the City Council shall cause an election to be held to fill the vacancy. The sixty (60) day period ends on February 2, 2023.

At the Council Meeting of December 20, 2022, the City Council directed staff to commence an application process and solicit community input. Following City Council’s direction, staff launched the District 4 City Council Vacancy page (www.anaheim.net/councilvacancy), which included information on the appointment process, the District 4 Vacancy Application, and an on-line community input form. The vacancy, call for applicants, and request for community input was advertised through various press releases, social media postings, flyers, and bilingual post cards, as well as messaging on the Anaheim Convention Center marquee on Katella Avenue, a main District 4 thoroughfare.

The application period for the vacancy opened on December 21, 2022, and closed on January 18, 2023 at 5:00 p.m. At the close of the application period, staff received applications from the candidates listed below (alphabetical by last name):

At the Council meeting of January 24, 2023, the City Council will follow the following format for the agenda item considering the District 4 City Council vacancy:

1. Candidate Opening Statements

2. City Council Questions/Answers with Candidates

3. Public Comment
If no appointment is made by February 2, 2023, the seat will be required to be filled by a special election. Government Code §36512(b)(1) requires the special election to be held on the next regularly established election date not less than 114 days from the call of the special election. The next possible upcoming election date would be November 7, 2023.

IMPACT ON BUDGET:

There is no budgetary impact associated with an appointment process to fill the vacancy.

If an appointment is not made by February 2, 2023 (sixty-days from vacancy), the Council must hold a special election at an estimated cost of $205,930 - $227,239.

Respectfully submitted, Concurred by,
Jim Vanderpool Theresa Bass
City Manager City Clerk
