Exercise of any of the above remedies, however, is an alternative to other remedies ANAHEIM may have and is not the exclusive remedy for CONSULTANT ’S failure to maintain insurance or secure appropriate endorsements.
21 Nothing herein contained shall be construed in any way as limiting the extent that an CONSULTANT may be held responsible for payments of damages to persons or property resulting from CONSULTANT’S, (or CONSULTANT’S AGENT or SUB-AGENT, if any) performance of the work covered under this Agreement.
In the event CONSULTANT hires other persons or firms to perform some of the work related to this Agreement, CONSULTANT shall ensure (i) that the acts or omissions of such persons or firms are covered under the above-referenced liability insurance, or (ii) that such firms maintain insurance equal to or better than, and subject to the same limits, terms and conditions as, the insurance required of CONSULTANT under this Agreement (except for firms that are not performing professional services —such firms shall not be required to carry the above -referenced professional liability insurance); and in either instance, CONSULTANT shall provide, or cause to be provided, evidence of such insurance coverage, reasonably acceptable to ANAHEIM.
ANAHEIM’S Risk Manager is hereby authorized to amend the requirements set forth herein in the event that such reduction is in ANAHEIM’S best interest.
22 Appendix II – Standard Indemnification Provision
The following represents the City’s standard language for the indemnification, defense and hold harmless provisions in its contracts. With very few exceptions, the language in the final Agreement will be as shown here. If a proposer has any specific concerns regarding any of the City’s indemnification language that would render the proposer unable or unwilling to enter into an Agreement with the City, proposer shall identify these concerns in their proposal. Deviations from the City’s standard language may be considered by City in its evaluation of the responsiveness of a proposal.
[Note: Proposer should also be aware it is the City’s practice not to enter into Agreements that contain restrictive limitation of liabi lity language or provisions. This includes language and provisions seeking to limit or restrict liability based on cost of services performed or goods provided.]
INDEMNIFICATION
As respects acts, errors or omissions in the performance of professional services, CONSULTANT agrees to indemnify and hold harmless ANAHEIM, its officials, officers, and employees from and against any and all claims, losses, damages, defense costs, or liability, of any kind or nature, arising directly out of the negligent acts, er rors or omissions of the CONSULTANT or any SUB -AGENT in the performance of professional services under this Agreement
As respects all acts, errors or omissions that do not arise directly out of the performance of professional services, including but not limited to those acts, errors or omissions typically covered by general and automobile liability insurance, CONSULTANT agrees to indemnify, defend (at ANAHEIM' S option), and hold harmless ANAHEIM, its officials, officers, employees , agents, and representatives from and against any and all claims, losses, damages, defense costs, or liability, of any kind or nature (collectively referred to hereinafter as “Claims”), arising out of or in connection with CONSULTANT’S (or CONSULTANT'S AGENT or SUB-AGENT, if any) acts, errors, omissions, or work, relative to this Agreement; except for those Claims that arise out of the sole negligence or willful misconduct of ANAHEIM.
The obligations set forth in this indemnification provision (i) shall be in effect without regard to whether or not ANAHEIM, CONSULTANT, or any other person maintains, or fails to maintain, insurance coverage, or a self-insurance program, for any such Claims; and (ii) shall survive the termination of this Agreement.

EXECUTIVE SUMMARY
Kaiser Permanente appreciates the opportunity to respond to the City of Anaheim’s request for proposal for occupational health services. Kaiser Permanente is uniquely positioned as a totally integrated healthcare system. As such, using our electronic health record, HealthConnect™ and with proper HIPAA releases, our physicians can access a majority of your employees’ relevant medical information, allowing our physicians to potentially identify conditions that could negatively impact your employees’/applicants’ ability to safely perform their jobs. Proper and early identification leads to lower health care costs for the City of Anaheim, and potentially minimizes your Workers’ Compensation risks and costs, while leading to improved health and productivity of your workforce. Approximately 52% of the City of Anaheim employees have chosen Kaiser Permanente as their health plan.
Kaiser Permanente On-the-Job® can help the City of Anaheim reduce costs, mitigate health and safety risks, and boost employee performance with a comprehensive occupational health and safety services program.
We are experts in keeping employees safe and healthy on the job, and that expertise is demonstrated in our:
HIGH-QUALITY CARE
We promote consistent standards and best practices in occupational health and safety throughout our integrated system.
Our highly skilled physicians are dedicated to occupational health services and have an in-depth understanding of the complexities of workforce regulations. Our extensive peer reviews and continuing medical education requirements ensure physician and staff quality remains high.
We train, certify, and monitor all our technicians for regulatory compliance and testing accuracy.
FOCUS ON PREVENTION
We work with you to maximize employee participation and identify potential health or safety problems before they result in reduced productivity or worksite injury. Our electronic health information system, Kaiser Permanente HealthConnect™, enables us to trend data over time and identify developing work-related health issues, such as hearing or lung function loss, so that employees can take preventive measures before the problem becomes serious.
CONVENIENCE
In our integrated system, your employees can easily access services at any of our centrally located, dedicated occupational health facilities.
Services are by appointment only, so your employees’ time away from work is minimized. We bring selected services to the workplace to make it easier for employees to participate.
EXTENSIVE EXPERIENCE IN MEETING EMPLOYER NEEDS

KPOJ provides a wide range of workers’ compensation medical care and occupational health and safety services including the following:

Related medical monitoring services
In addition to the services described above, Kaiser Permanente On-the-Job® has extensive experience in providing the complete set of services as requested and described in the City of Anaheim RFP. Specifically, in the area of medical monitoring and surveillance, Kaiser Permanente On-the-Job® employs a service model that consistently monitors and evaluates the appropriateness of care for all of our medical services. Our infrastructure identifies both patterns of care and single clinical events that are variances from the clinical practice guidelines to understand changing needs in our patient population. Our electronic health information system, HealthConnect™, is a key component of our medical monitoring and surveillance infrastructure, and also helps to improve overall patient care as it makes possible real-time information exchanges between our KPOJ and medical clinics. We use HealthConnect™ in concert with proprietary information management systems, to track and document workers’ compensation cases from the employee’s first visit through case closure. These systems are used to record all the relevant details of injury and illness visits and generate reports including those used for claims tracking and all case management tasks. We then review this information to look for problems or patterns which may require targeted prevention.
In addition, to ensure optimal staffing and resource allocation, we regularly evaluate utilization at our KPOJ clinics, as well as services contracted or referred outside the department. Our goal is to identify the potential areas of concern and to evaluate the effectiveness of existing worksite preventive strategies. Our goal is to help control the cost of occupational medical support while maintaining a high level of quality in care and service. Kaiser Permanente Medical Group, LLP performs annual external audit of The Permanente Medical Group in Northern California and the Southern California Permanente Medical Group, respectively. The audit results are made available to Kaiser Foundation Health Plan, Inc. In addition, our Financial
Planning, Internal Audit and General Accounting departments internally monitor the Permanente Medical Groups' financial performance on an ongoing basis.
Kaiser Permanente does not subscribe to Dun & Bradstreet. However, Kaiser Foundation Hospitals and Kaiser Foundation Health Plan, Inc. and Subsidiaries are rated AA- by Standard & Poor’s and AA- by Fitch Ratings for Financial Strength (an insurer rating) and for all currently outstanding debt (a bond rating) issued by and for the entities. The ratings apply to each health plan entity including the regional subsidiaries and KPIC.
