CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 7, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: APPROVE THE CLEAN CALIFORNIA MAINTENANCE
AGREEMENT
ATTACHMENT (Y/N): YES ITEM # 06
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion:
1) Determine that the projects to be performed under the attached Maintenance Agreement shall be categorically exempt under the California Environmental Quality Act (CEQA), Section 15308 of Title 14 of the California Code of Regulations;
2) Approve the Clean California Maintenance Agreement (“Agreement”) between the City of Anaheim (“City”) and the Department of Transportation (“State”) under the “Clean California Beautification Program of 2021” which identifies specific mission-critical maintenance services to be performed on and around the State right of way within the City’s jurisdictional limits and authorize the Director of Public Works to execute the Agreement on behalf of the City and to take any and all actions as are necessary to implement and administer the Agreement; and 3) Authorize de minimis changes that do not substantially change the terms and conditions of the Agreement, as determined by the City Attorney.
DISCUSSION:
Under the Clean California Beautification Program, the State of California proposes significant investments in litter collection, community engagement, and education to mitigate the trash that has plagued California streets and highways and to transform unsightly roadsides. This statewide effort is a collaboration with all 58 counties; with a third of the funds anticipated to go directly to cities, counties, tribes, and transit agencies to clean the local streets and public spaces.
The Clean California Beautification Program seeks to allocate over $1 billion in funds for litter abatement, state beautification projects, local beautification projects, public education, project design, construction, local support, and engagement. This particular agreement seeks to expand litter pick-up, reduce trash from state and local roads, and expand community services programs and volunteering. The City shall perform litter, debris, and graffiti removal as set forth in the Agreement and is required to uphold stringent scheduling, billing, permit, payment, and reporting requirements.
Approve the Clean California Maintenance Agreement
February 7, 2023
ENVIRONMENTAL DETERMINATION:
The projects to be undertaken under this Agreement will consist of actions taken by regulatory agencies, as authorized by the State or local ordinance, to assure the maintenance, restoration, enhancements, or protection of the environment which fall under CEQA Categorical Exemptions, Section 15308 of Title 14 of the California Code of Regulations.
IMPACT ON BUDGET:
Agreement is expected to be cost neutral since the State will reimburse the City for costs incurred.
Respectfully submitted,
Rudy Emami
Director of Public Works
