CITY COUNCIL AGENDA REPORT
City of Anaheim

PLANNING AND BUILDING DEPARTMENT
DATE: FEBRUARY 7, 2023
FROM: PLANNING & BUILDING AND FIRE & RESCUE

DEPARTMENTS
SUBJECT: 2022 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODES AND THE 2022 CALIFORNIA FIRE CODE
ATTACHMENT (Y/N): YES ITEM # 13
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, take the following actions:
1) Determine that the proposed Ordinances are exempt from the California Environmental Quality Act (CEQA) under Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that there is no possibility that adoption of the ordinances may have a significant effect on the environment;
2) Introduce Ordinances of the City of Anaheim repealing Chapters 15.03 (Building Standards Codes Pertaining to Building and Construction) and 16.08 (California Fire Code) of the Anaheim Municipal Code, and adding new Chapters 15.03 (Building Standards Codes and Administrative Provisions Pertaining to Building and Construction) and 16.08 (California Fire Code) of the Anaheim Municipal Code; and
3) Authorize and direct the City Clerk to schedule a public hearing on said Ordinances for March 7, 2023, and to publish notice of said public hearing pursuant to Section 50022.3 of the California Government Code.

DISCUSSION:

Every three years the California Building Standards Commission ("Commission") compiles and publishes the adoption, amendment, and repeal of administrative regulations to Title 24 of the California Code of Regulations, also referred to as the "California Building Standards Code." The California Building Standards Code includes the following: California Building Code, Residential Code, Electrical Code, Mechanical Code, Plumbing Code, Energy Code, Historical Building Code, Green Building Standards Code, Existing Building Code, Referenced Standards Code, the Uniform Code for the Abatement of Dangerous Buildings, and the California Fire Code (hereinafter referred to collectively as "Codes"). Effective January 1, 2023, these Codes are applicable to all jurisdictions in California and are designed to be Adoption of the 2022 Edition of the California Building Standards Codes February 7, 2023

adopted by reference by local agencies with such modifications or changes as local agencies find and determine are reasonably necessary because of local climatic, geological, or topographical conditions.

The Building Official and the Fire Chief recommend that the Council introduce the proposed ordinances, which, once adopted following a public hearing to be scheduled for March 7, 2023, will adopt the Codes by reference. Local amendments to the 2022 Codes are developed in collaboration with surrounding jurisdictions to create consistent and predictable requirements in our region. The proposed local amendments are largely the same as those that were adopted as part of the 2019 Code.

These amendments pertain to permitted roofing materials, concrete and masonry foundation walls, swimming pool barriers, and small electrical wire installations and are intended to mitigate local life safety concerns such as fire hazards and seismic conditions.

The Fire Department proposes one new amendment to the 2022 California Fire Code to provide continuity and consistency among Orange County Fire Agencies and to utilize technology to enhance the safety of our community. This amendment would require existing buildings undergoing a substantial amount of construction to retrofit fire sprinklers when one of the following conditions is met:

1. An addition of 33% or more to an existing building area, and the resulting building area exceeds 5,000 square feet;

2. An addition exceeds 2,000 square feet, and the resulting building area exceeds 5,000 square feet; or

3. An additional story is added above the second floor regardless of fire areas or allowable area.

In accordance with Section 50022.3 of the California Government Code, adoption of the Codes by reference with local amendments requires that the City Council introduce the proposed Ordinances and schedule a time and place for a public hearing to consider whether or not to adopt the Codes, as amended. Accordingly, it is requested that the City Council, by motion, direct the City Clerk to schedule a public hearing on said Ordinances for March 7, 2023, and to publish notice of said public hearing pursuant to Section 50022.3 of the California Government Code.

IMPACT ON BUDGET:

There is no budgetary impact since costs to enforce these Codes are funded by developers and contractors through the review and issuance of development permits.

Respectfully submitted, Concurred by,
Ted White Patrick Russell
Planning and Building Director Fire Chief
