CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 28, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: TEMPORARY CONSTRUCTION EASEMENT AGREEMENT FOR
PROPERTY LOCATED AT 760 NORTH EUCLID STREET FOR THE

EUCLID STREET FROM GLENOAKS AVENUE TO CRESCENT

AVENUE CORRIDOR IMPROVEMENT PROJECT
(R/W ACQ2020-01274)
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve the Temporary Construction Easement Agreement (Agreement) for the property located at 760 North Euclid Street for a 14 month term, authorize and direct the Mayor and City Clerk to execute the Agreement on behalf of the city, and authorize the total payment of $1,000 for the Euclid Street from Glenoaks Avenue to Crescent Avenue Corridor Improvement (Project) to Glenoaks Business Center, a California Limited Liability Company.

DISCUSSION:

The Department of Public Works is acquiring a Temporary Construction Easement (TCE) at 760 North Euclid Street for improvements at the intersection of Euclid Street and Glenoaks Avenue. A TCE is necessary for the City’s contractor to gain access to the property for demolition and for construction of the project improvements. In addition, the TCE grants the City’s contractors, agents, and employees the right to construct an asphalt driveway approach, concrete curb, landscaping, and to perform limited grading to conform to the new street grade in conjunction with the project. No permanent property acquisition is needed for the Project.

Euclid Street is designated as a Primary Arterial on the City’s Planned Roadway Network.

The existing configuration of Euclid Street is six travel lanes with left turn pockets to accommodate vehicles at a signalized intersection of Glenoaks Avenue. The Project will upgrade the Euclid Street and Glenoaks Avenue intersection with new traffic signal mast arms and poles to include protected left turn phasing and Americans with Disabilities Act compliant curb ramps.

The property owner agreed to a price of $1,000 for the TCE which is based on fair market value. The TCE will be in effect for fourteen months from the date payment is provided to the property owner. The City previously obtained a TCE at this location however due to project delays the TCE has expired. The construction of the project is now expected to begin in the spring of 2023.
