ADVOCATES PLAN TO CONTINUE WORK ON SEVERAL EDUCATION
BILLS
Postedon
ByAnitaAvrick, MelanieLucasandBethMeyerhoff, CaliforniaStatePTA EducationAdvocates
TheCaliforniaStatePTAtakespositionsonbills to improvethe lives of children andfamilies.

TheLegislationTeamreadshundredsof bills a year. TheLegislationAction CommitteethenmeetsmonthlybetweenJanuaryandJuneto discussandtake positionsonbills that fulfill ourMissionStatementto “positivelyimpactthe lives of all childrenandfamilies.”
During2021, the Educationadvocatesresearchedmanybills affectingK-12public schooleducation, basedonourauthorities, whichconsistof ourlegislative planks, resolutions, andpositionstatements. Althoughthe bills listed belowdid not proceedthroughthe full legislativeprocessto reachGovernorGavin 2 Newsom’s deskandwerenot signedinto law, CaliforniaStatePTAcontinuesto supportthe issuesthesebills address.

Wehopethat the legislaturewill againdiscussthesebills whentheyreconvene in January2022.

SenateBill 70 (Rubio). Elementaryeducation: kindergarten Thisbill wouldrequirethat a studentcompleteoneyearof kindergartenbefore beingadmittedto first grade. Studentswouldbeginfirst gradeif theyhadtheir 6th birthdayonor beforeSeptember1 andhadcompletedoneyearof kindergarten.

Currently, EducationCodeSection48200requireseverypersonbetweenthe ages of 6 and18yearsto attendschoolfull-time. Studentsmustbeadmittedto first gradeif they havetheir 6th birthdayon or beforeSeptember1.

Accordingto the author, kindergartenerswhomiss10% or moreof schooldays havelower academicperformancewhentheyreachfirst grade. Theimpactis evengreaterfor studentswhodonot attendkindergartenat all.

AB1444 (Buchanan, 2014) wouldhaverequireda studentto havecompleted kindergartenbeforebeingadmittedto first grade. GovernorBrownvetoedAB 1444, sayingthat hepreferredto let parentsdeterminewhat is bestfor their childrenratherthanmandateanentirely newgradelevel.

Themajorityof eligiblechildrenin Californiadoattendkindergarten, including approximately95% of eligiblestudents (publicandprivatekindergarten) with 80% at a publicschool, as estimatedby the Departmentof Education (CDE).

Accordingto the CaliforniaKindergartenAssociation, anestimatedfive- to seven percentof studentsdonot enroll in kindergarten. (EdSource, March3, 2021) CaliforniaPTAsupportsthis bill becausewe believethat earlylearningis crucial, especiallyfor ourmostvulnerablepopulation. Makingkindergartenmandatory will helpthosechildrenwhoaremostlikely to fall behinddueto the lack of early learningprograms. Sincekindergartenis optional, it canleadsomefamiliesto believethat it is not importantor that attendanceis not essential.

SenateBill 723 (Rubio). Pupilinstruction: tutoringprogram: learningloss mitigation
3 Amongthe manychallengesduringdistancelearningis a rising opportunitygap.

SenateBill 723wouldaddresslearningloss andprovidestudentswith tutoringas a documentedstrategyto closeopportunitygaps. Thetutoringwouldbeprovided by collegestudentsandotherpupilsthroughthe CaliforniaLeadership, Excellence, Academic, Diversity, andService-LearningTutoringProgram.

CaliforniaStatePTAsupportslegislationthat canimproveacademicachievement for all studentsandeliminatethe achievementgap. PTAbelievesit is important to provideall studentswith equalopportunityto learnand, whennecessary, to provideaccessto appropriateinterventionstrategiesandremediationprograms for academicsuccess.

Additionalfundingandsupportfor this programwasincludedin AssemblyBill 86 whichappropriated $4.6 billion to providesupportandtutoringby certificated or classifiedemployees.

AssemblyBill 520 (Gipson). Teacherretention: CaliforniaDiversifyingthe Teacher WorkforceGrantProgram
Thisbill wouldestablishthe CaliforniaDiversifyingthe TeacherWorkforceGrant Programto provideone-time competitivegrantsto developandimplementnewor expandexisting programsto developandretain a diverseteacherworkforce.

Accordingto the author, California’s teachingforceis significantlyless racially andethnicallydiversethanthe studentpopulation. Forexample, accordingto the CaliforniaDepartmentof Education (CDE), 23% percentof K-12studentsare white and54% areLatino, while 63% of teachersarewhite and20% areLatino.

AssemblymemberGipsonstates, “Studentsuccessis amplifiedwhenthey are taughtby teacherswhoreflect the diversityof thosestudents. In additionto academicbenefits, studentsof color experiencesocial-emotionalgainsto having teacherswholook like them, alsolesseningthe likelihoodof chronic absenteeismandsuspension.”
CaliforniaStatePTAhasa resolution, TEACHERQUALITY: RECRUITMENT, RETENTIONANDRESOURCES (2012), that supports “policies, programs, and practicesthat promotethe recruitment, hiringandretentionof well prepared, fully credentialedteachers.”
AssemblyBill 285 (Holden). StateDepartmentof Education: state schoolnurse consultant 4
AB285wouldrequirethe StateDepartmentof Educationto appointan experiencedstate schoolnurseconsultantwith a minimumof 5 yearsof experience. Thestate schoolnursewouldpromotequality schoolprogramsto supportthe healthneedsof students.

Californiais oneof 10states without a schoolnurseofficial at the state level duringthe COVID-19pandemic.

CaliforniaStatePTAsupportslegislationthat encouragesa greaternumberof schoolnursesin schools. Appropriatehealthservicesby credentialednursesare vital to students, especiallyduringthis pandemic. A schoolnurseconsultantat the state level will improvethe healthassistanceandguidanceourschool districts canprovidestudents.

AssemblyBill 299 (Villapudua). Careertechnicaleducation: California ApprenticeshipGrantProgram
AB299wouldestablishthe CaliforniaApprenticeshipGrantProgramto provide grantsto highschoolpupils, communitycollegestudents, andemployedand unemployedworkersto entercareertechnicaleducationandvocational professionsthroughstate-approvedapprenticeships.

CaliforniaStatePTAsupportscontinuedandsufficient fundingof School-to- Careereducation. Webelievethat apprenticeshipsgivecommunitycollege studentsnot onlyadditionalfundsfor continuingtheir educationbut a step upon their careerpath.

SenateBill 237 (Portantino). Specialeducation: dyslexiarisk screening SB237wouldrequirethe StateBoardof Educationto establishanapprovedlist of culturally, linguistically, anddevelopmentallyappropriatescreening instrumentsto beusedby schoolsto screenpupilsfor risk of dyslexia.

Localeducationalagencies (LEAs) wouldberequiredto annuallyscreenall pupils in gradeskindergartenthroughsecondgradefor risk of dyslexiausingthe screeninginstrumentsapprovedby the StateBoardof Education. Thisbill would alsorequirethird-gradepupilsto bescreenedduringthe initial yearof implementation. LEAswouldalsoberequiredto provideresultsto parentswithin 45daysof the screening. LEAswouldberequiredto provideall pupilsidentified as beingat risk of dyslexiawith appropriateinstruction, progressmonitoring, and early interventionin the regulargeneraleducationprogram. 5 Accordingto the bill’s author, “Studentswith dyslexiaareless likely to graduate fromhighschoolandattendcollege, andalsoexperiencehigherratesof incarceration. In someprisonstoday, wherenearly80% of the inmatesare illiterate, almostone-half of the inmatesareon the dyslexiaspectrum.

Researchevidencefrommultiplescientific studiesis unequivocal: early identificationandinterventionwith scientifically basedearlyreadinginstruction strategiesandmaterialsimproveliteracy outcomesfor studentswith dyslexia andotherstrugglingreaders.

Byscreeningall studentsfor risk of dyslexiaearly, Californiacanhelpfamilies andteachersachievethe bestlearningandlife outcomesfor all students, close academicachievementgaps, andhelpendthe school-to-prisonpipeline.” CaliforniaStatePTAstronglysupportsearlyscreeningfor signsandsymptomsof dyslexiaandthe useof appropriateaccommodationsto providestudentswith dyslexiaequitableaccessto the generaleducationcurriculumas identifiedin the CaliforniaStatePTAResolution, “Dyslexia: Addressingthe Educational Implicationsin PublicSchools.”

MULTIPLEBILLSADDRESSING
STUDENTS’ MENTALHEALTHARENOW
LAW
Postedon
ByBethMeyerhoff, CaliforniaStatePTAAdvocate
Fearandisolationheightenedduringthe pandemichavereinforcedCalifornia StatePTA’s long-standingcommitmentto the mentalhealthof childrenandthe needfor adult educationto addressyouthmentalhealthchallenges. Our advocacyteamapplaudsGovernorGavinNewsom’s signingof a trio of bills to supportthe mentalhealthneedsof students.
6 SenateBill 14 (Portantino) mandatesthat studentabsencesfor mentaland behavioralhealthare treatedthe sameas excusedabsencesfor physicalhealth.

Thirty percentof highschoolstudentsreportexperiencingsymptomsof depressionandCOVID-19hasfurtherincreasedthe mentalhealthissueschildren faceaccordingto reportscited by SenatorPortantino, the authorof this bill.

Thanksto SB14, behavioralhealthwill nowbeincludedwithin the “illness categories” that arelegallyconsideredexcusedabsences (EducationCode Section48205). In addition, the CaliforniaDepartmentof Education (CDE) must identify a trainingprogramto addressyouthbehavioralhealth.

CaliforniaStatePTAbelievesbehavioralhealthevaluationandservicesare critical for studentdevelopment. Wesupportprovidinginformationandeducation to understandandsustainchildren, youth, andfamilybehavioralhealthand social-emotionaldevelopment.

SenateBill 224 (Portantino) requiresmiddleandhighschoolsto include instruction in mentalhealthif the schoolsoffer coursesin healtheducation.

Forschoolsthat offerhealtheducationcourses, this bill requiresthat those coursesincludementalhealthinstruction. Thecourseshall coversymptomsof commonmentalhealthchallenges, promotingmentalhealthwellness, andhowto find assistancefromprofessionals, amongotherrequirements. Additionally, it shall includedevelopinganawarenessof mentalhealthchallengesacrossall populationsand “the impactof race, ethnicity andcultureonthe experienceand treatmentof mentalhealthchallenges.” TheStateDepartmentof Educationmust developa planto expandmentalhealthinstructionin Californiapublicschoolson or beforeJanuary1, 2024.

Accordingto SenatorPortantino’s office, “Educationaboutmentalhealthis one of the bestwaysto increaseawareness, empowerstudentsto seekhelp, and reducethe stigmaassociatedwith mentalhealthchallenges.” CaliforniaStatePTAsupportsage-appropriatesocialandemotionallearningand mentalhealtheducationfor all students. Asanadvocacyorganization, California StatePTAsupportslegislationthat createsa safeandacceptingenvironmentin schools.
7 AssemblyBill 309 (Gabriel) requiresthe CaliforniaDepartmentof Education (CDE) to developmodelreferralprotocolsfor addressingpupil mentalhealth.

Thedevelopmentof modelmentalhealthprotocolsrequiredby this bill would guideschoolsandlocal educationalagencies (LEAs) in “appropriateandtimely interventionfor pupilmentalhealthconcerns.” Theprotocolswill bepostedon the CDEwebsiteandusedona voluntarybasis.

TheAssemblyBill analysisquotedthe StudentMentalHealthPolicyWorkgroup whichnotedthe connectionbetweenmentalwellnessandacademic achievement, attendance, andbehavior. TheWorkgroupalsosaidCalifornia’s educatorsacknowledgetheir lack of preparednessin addressingpupilmental healthchallengesas a majorbarrierto instruction.

CaliforniaStatePTApassedits resolution, MentalHealth: Treatmentand Supportin 1999 (reviewed2017), callingon “ the CaliforniaStatePTAandits units, councilsanddistricts \[to\] urgethat membersof the educationcommunity andlocal law enforcementagenciesreceivetrainingto ensurethat peace officersandeducatorscanrecognizesymptomsof mentalillness and appropriatelyrespondwhendealingwith persons, especiallychildren, andyouth, whoshowsignsof mentalillness.”
In addition, at the 2020CaliforniaStatePTAConvention, memberspasseda resolutionMentalHealthServicefor OurChildrenandYouthto supportmental healthwellnessandsocial-emotionallearningpolicies, includingstaff training.

I amanadvocatefortherightsof childrenandfatherof twodevelopmentallydisabledchildren, one withautism, theotherwithattentiondeficithyperactivitydisorder, orADHD. There’sanurgent needforbothpublicawarenessandlegislationfortrainingourpoliceandfiredepartments, emergencyagenciesandeducationalemployeestorecognizeandproperlyhandlethebehaviorof thedevelopmentallydisabledandmentallyill.

Thisyear, policein Californiarespondedtoatleasttwocasesinvolvingdevelopmentallydisabled ormentallyill peoplethatresultedindeath. Theofficersweren’t properlytrainedtodistinguish betweencriminalbehaviorandthebehaviorof mentallyill individuals. Theofficersincorrectly assumedthepeopleweredisplayingthreateningornon-compliantbehavior. Andthisproblemis notjuststatewide, it’snational, andit’sgrowing.
1 Onecasewasin SanDiego, onFeb. 8, involvingWilliamAnthonyMiller, 42. ApparentlyMiller, a longtimehomelessSanDiegan, washittingpedestrianswithatreebranch. Whenofficersarrived onthescenetheyorderedMillertodropthebranch. Miller, whosuffersfrommentalillness, didnot complyandinsteadchargedatofficerswiththetreebranch. Threeof thefiveofficersopenedfire onMiller, killinghiminstantly. Heeasilycouldhavebeensubduedbyanet.

A differentscenarioplayedout onFeb. 26in OrangeCounty. RoseV. Failla, 52, aresident of Fullertonwhofamilymemberssaidhasahistoryof mentalillness, allegedlystolean ambulancein Anaheimandplowedinto acar, killing twopeople.

Originally, concernedneighborsnoticedFaillawanderingaroundtheir backyardand calledauthorities. Policerespondedand, basedontheir limited trainingandbackground, incorrectlydeterminedthat Faillawasnot eligibleto beadmittedfor a72-hour observationbyaqualifiedhealthprofessionalin amentalhealthfacility. Shelater admittedherselfinto AnaheimMemorialMedicalCenterfor treatment. Beforedoctors couldgetto her, sheranoutsidethehospitalanddroveoff in anunattendedambulance with thekeysinside.

Althoughtheliability heredoesnot belongto theOrangePoliceDepartment, thissituation clearlyshowsthat thepolice’sdeterminationof whois athreatto themselvesandothers waswayoff themark. Simplyput: Theyneedspecialtraining andtheyneedit now.

Currently, thereis nocontinuouseducationandtrainingfor emergencypersonneland agenciesto identifycertainbehaviorandhandlethesesituationsaccordingly.

SeveralpendingAssemblybills addresstheissueof training programs.

Since1999, therehavebeeneffortsin researching, raisingpublicawarenessandseeking legislation, at agrass-rootslevel. Until now, with theexceptionof theOrangeCounty PoliceChiefsAssn., theseagencieshaveremainedrelativelysilentonthisissue. Until annualforumsarecreatedwhereparents, childrenandprofessionalscanbeheard, there will beacontinuinggapbetweencommunitypolicingandcitizens, andunfortunatelymore unnecessarydeaths.
