ATTACHMENT (Y/N): YES ITEM # 02

GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, Bonadiman Water Inc., of Riverside, CA, Contractor’s License No. 1045913, Classification A, in the amount of $487,210, for the Citywide Sanitary Sewer Improvement on Brookhurst Street North of Lincoln Avenue (Project); authorize and direct the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; authorize and direct the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine the Project is Categorically Exempt under the California Environmental Quality Act (CEQA) pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the California Code of Regulations.

DISCUSSION:

The bids are summarized as follows:

1. Bonadiman Water Inc., Riverside, CA………………………………...…$487,210

2. Kordich Construction Inc., Cypress, CA………………..……………..…$589,128

3. Vasilj Inc., Irwindale, CA………………………………………………...$673,490 This Project will address ongoing sanitary sewer maintenance and capacity issues in the City’s West Anaheim area by improving overall performance, reducing maintenance costs, ensuring capacity for future development, and ensuring the reliability of the system.

The work consists of sewer improvements in Brookhurst Street north of Lincoln Avenue. Sewer flow will be rerouted to eliminate the existing inverted siphon by extending the westerly sewer main south towards Lincoln Avenue. The existing 8” sewer main that crosses from west to east will be abandoned including the existing siphon. This work also includes the removal and replacement of a sag along the westerly sewer main.

The bid price reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this Project shall be $1,000 per day.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the CCR which consists of construction and location of limited numbers of new, small facilities or structures and specifically exempts water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the Project List.

The Project List (Attachment F to the CWA) as approved by the City Council identifies projects in which the CWA shall apply. In determining project application, the CWA Project List was based on the Capital Improvement Program that may be adjusted annually based on City priorities, availability of funding, and other considerations. The intent in the development of the Project List is that larger projects be included due to the additional administrative activities associated with the CWA and minimize the impact of the additional administrative functions and costs for the City and for smaller construction firms.

IMPACT ON BUDGET:

Sufficient funding is available in the FY 2022/23 Public Works Department’s Wastewater Fund budget and Public Utilities’ Water Utility Fund budget.

Respectfully submitted,
Rudy Emami
Director of Public Works
