CITY COUNCIL AGENDA REPORT
City of Anaheim

POLICE DEPARTMENT
DATE: APRIL 4, 2023
FROM: POLICE DEPARTMENT
SUBJECT: PILOT PROGRAM WITH LYONS SECURITY SERVICE, INC.

FOR ABANDONED PROPERTY REMOVAL SERVICES
ATTACHMENT (Y/N): YES ITEM # 03
GOVERNMENT CODE § 84308 APPLIES: YES
ACTION:

That the City Council, by Motion, waive Council Policy 4.0 and approve an agreement with Lyons Security Service, Inc., in the amount not to exceed $245,018.87, for a pilot program, not to exceed one year, for Abandoned Property Removal Services; and authorize the City Manager, or his designee, to execute and administer the agreement.

DISCUSSION:

Requests for the removal of abandoned property left in public spaces are frequently received by the City of Anaheim from residents and personnel of different departments.

To maintain the intended use and accessibility of public spaces for all citizens, Anaheim Municipal Code section 11.10.050 allows the City, under the authority of the Chief of Police, the authority to remove abandoned property from public spaces, restoring them to a clean, safe and accessible condition. Currently, Code Enforcement Officers work together with the Police Department to remove, store, and return abandoned property, freeing up Police Officers to focus on their designated duties. However, this has resulted in Code Enforcement having to redistribute their limited resources to provide this assistance to the Police Department, which in turn curtails their ability to address other code enforcement matters in an efficient and effective manner. City staff proposes a pilot program, not to exceed one year, with Lyons Security Service, Inc. (Lyons), to have Lyons remove abandoned property from public spaces and to transport the abandoned property to City storage sites to be temporarily stored within the guidelines of the municipal code. Currently, the Police Department budgets for abandoned property removal and instead of utilizing Code Enforcement staff, proposes utilizing contractors who can provide additional hours at the same budgeted amount. Additionally, this will allow for Code Enforcement officers to resume code enforcement duties which include improving commercial corridors and quality rental housing.

City staff researched the ability to contract out abandoned property removal services to augment property removal hours and operations, unfortunately there are limited companies and those that staff reached out to respectfully declined. Lyons has been rendering its services within the City of Anaheim, including security provisions at parks, Pilot Program with Lyons Security Service, Inc. for Abandoned Property Removal Services April 4, 2023

city hall, and other service providers. They have the ability to quickly scale up and provide the requested services within 30 days of the execution of the agreement. During the pilot period, staff will conduct a comprehensive Request for Proposal (RFP) process to enhance abandoned property removal services. The agreement with Lyons during the Pilot Program includes their calculations for projected labor hours and vehicle costs resulting in a not to exceed amount of $245,018.87. Assigned Lyons staff will dedicate their time as part of the agreement on picking up, transporting, and releasing abandoned property, which will relieve Police Officers and Code Enforcement Officers to focus their efforts on their designated responsibilities.

IMPACT ON BUDGET:

Sufficient funds are available in the FY 22/23 Police Department Budget.

Respectfully Submitted, Concurred by,
