CENTER GREENS IMPROVEMENTS (RE-BID)
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion:
1) Award the construction contract to the lowest responsive and responsible bidder, Solex Construction Inc. of Los Angeles, CA, Contractor’s License No. 898681, Classification B in the amount of $5,885,645.30 for the Center Greens Improvements (RE-BID) (Project); authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and
2) Determine the Project is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to Sections 15301, 15302, 15303(c)(d)(e), 15304(e)(f), and 15300.2(c). This project is identified as Class 1 (existing facilities), Class 3 (new construction or conversion of small structures) & Class 4 (minor land alteration) pursuant to Title 14 of the California Code of Regulations.

DISCUSSION:

The project consists of the renovation of approximately 3.5 acres, including new landscaping and irrigation, new and relocated lighting, upgraded basketball court, new skate park, challenge course, decomposed granite pathways, concrete pathways and other hardscape, shade structure, seat walls, water capture basins, furnishing, and other appurtenant work as shown on the approved plans and specifications. Determination of the lowest responsive bidder for the selected project scope was made in accordance with Public Contract Code 20103.8(d).

The bids are summarized as follows:

1. Solex Construction Inc., Los Angeles, CA ...........................................$5,885,645.30

2. Archico Design Build Inc., Santa Ana, CA ...........................................$6,346,427.00

4. Tovey Shultz Construction, Inc., Lake Elsinore, CA ............................$6,836,981.00 The initial round of bidding resulted in bids that significantly exceeded the engineer’s estimate.

This is the second request for bids and reflects changes in the scope of work that align with the augmented construction budget. Four bids were received in the re-bid. The project specifications required that bidders submit a Statement of Qualifications with past projects of similar size and scope to be deemed responsive and responsible. Based on the information submitted on the Statement of Qualifications, staff determined the lowest bidder met the minimum requirements with projects of similar size and scope.

The bid price reflects the current bidding environment, is consistent with the engineer’s estimate, appears to be reasonable, and is within the available funding. Construction is scheduled to begin May 2023 and is scheduled to be completed in Winter 2023. Liquidated damages are set for $1,500 per day.

ENVIRONMENTAL REVIEW:

The Department recommends that City Council determine that the Project is categorically exempt from CEQA pursuant to sections 15301, 15302, 15303(c)(d)(e), 15304(e)(f), and 15300.2(c). This project is identified as Class 1 (existing facilities), Class 3 (new construction or conversion of small structures) & Class 4 (minor land alteration) pursuant to Title 14 of the California Code of Regulations.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This project is covered “Project Work” as defined in the CWA the City entered into with the Los Angeles / Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions.

IMPACT ON BUDGET:
