CITY COUNCIL AGENDA REPORT
City of Anaheim

PUBLIC UTILITIES DEPARTMENT
DATE: APRIL 18, 2023
FROM: PUBLIC UTILITIES DEPARTMENT
SUBJECT: APPROVAL OF LICENSE AGREEMENTS FOR EXISTING

ANAHEIM ELECTRIC UTILITY FACILITIES WITHIN
SOUTHERN CALIFORNIA EDISON’S TRANSMISSION RIGHT-
OF-WAY
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion:
1) Determine that the license agreements (Attachments 1 and 2) with the Southern California Edison Company (SCE) for existing Anaheim Public Utilities (APU) electric facilities and infrastructure to remain within the SCE right-of-way are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b) of Title 14 of the California Code of Regulations; and
2) Approve a five-year license agreement commencing July 1, 2023 to June 30, 2028, between the City of Anaheim (City) and SCE (SCE Contract No. 9.1579) for pole-line and cable/conduit purposes, in the amount of $15,206.15 for the first year with 5% annual escalations for subsequent years; and 3) Approve a five-year license agreement commencing July 1, 2023 to June 30, 2028, between the City and SCE (SCE Contract No. 9.1798) for pole-line and cable/conduit purposes, in the amount of $10,301.12 for the first year with 5% annual escalations for subsequent years; and
4) Authorize the Public Utilities General Manager, on behalf of the City as Licensee, to execute SCE Contract Nos. 9.1579 and 9.1798 (collectively the “License Agreements”) and any plans, notices, requests for Licensor’s approval, amendments, or other related documents, and to take such actions as reasonable or necessary to implement and administer the License Agreements, including (but not limited to) submitting plans, providing notices, and executing amendments.

DISCUSSION:

SCE has high voltage infrastructure that passes through the City, typically along public roadways or on properties owned by SCE. consideration are within SCE’s property and will allow APU’s existing poles, electric wires, and fiber optic cables to remain operational for an additional five-year term, from July 1, 2023 to June 30, 2028. The current license agreements for the same locations will expire on June 30, 2023. SCE requires that new license agreements be executed every five years in the event new state law or other requirements need to be addressed.

APU’s facilities are generally located near Lewis Street, Claudina Way, and Anaheim Way, north of the Interstate 5 freeway, within the SCE’s Barre-Villa Park 220 kilovolt (kV) right-of-way. APU’s infrastructure provides connectivity between electrical substations, and also serves businesses and residents in the area.

ENVIRONMENTAL REVIEW:

APU recommends that City Council determine that License Agreements are categorically exempt from CEQA pursuant to Section 15301(b) of Title 14 of the California Code of Regulations. These agreements allow continued operation and maintenance of existing APU’s electrical facilities, which do not have the potential to create a significant effect on the environment.

IMPACT ON THE BUDGET:

Sufficient funds are included in APU’s FY 2022/23 restricted Electric Utility Fund budget, and future years will be subject to City Council’s approval of budget appropriations.

Respectfully submitted,
Dukku Lee
Public Utilities General Manager
