CITY OF ANAHEIM, a California municipal corporation and charter city, hereinafter called CITY, hereby grants to the State of California, Department of Transportation, hereinafter called STATE, a non-exclusive easement for an overhead sign structure together with the necessary right of ingress/egress and incidents thereto upon, over and across that real property in the City of Anaheim , County of Orange, State of California, subject to all encumbrances, easements (recorded and/or unrecorded) covenants, conditions, restrictions and reservations described as follows:

CITY hereby reserves unto itself the rights to any utility lines, pipelines or other facilities (hereinafter "Improvements") currently existing within the area that are not shown in Official Records, regardless of whether such Improvements are apparent by physi cal inspection, including non- exclusive easement rights for ingress and egress to such Improvements and the right to repair, maintain, install, or remove said Improvements, inclusive of any necessary surface and subsurface rights related thereto.
STATE agrees to notify CITY in writing five (5) business days in advance of planned activities in, on, over, upon, or across the easement area. STATE shall notify the CITY in writing within five (5) days following the commencement of any emergency work within the easement areas.
CITY hereby further grants to STATE all trees, growths (growing or that may hereinafter grow) and road building materials within the right of way including the right to take water, together with the right to use same in such manner and at such location as the STATE may deem proper, needful or necessary for the construction, reconstruction, improvement or maintenance of the highway.
