CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: MAY 16, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: ANAHEIM RESORT MAINTENANCE DISTRICT ANNUAL

LEVY AND COLLECTION OF ASSESSMENTS
ATTACHMENT (Y/N): YES ITEM # 16
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by separate Resolutions:
1) Initiate proceedings for the annual levy of assessments in, and accepting an Assessment Engineer’s Report for, the Anaheim Resort Maintenance District; and 2) Declare the City of Anaheim’s intention to provide for an annual levy and collection of assessments in the Anaheim Resort Maintenance District for Fiscal Year 2023/24 and set a time and place for the public hearing thereon.

DISCUSSION:

The Anaheim Resort Maintenance District was formed on July 1, 1999, by action of the City Council and based upon a vote to do so by the property owners in the area known as the Anaheim Resort. The property owners in the Anaheim Resort voted to levy an assessment upon themselves to ensure the long-term quality of maintenance, repair and replacement of Anaheim Resort area public improvements and presentation of festive elements consistent with the operation of a truly unique and outstanding destination area.

The levy and special assessments fund the cost of the annual maintenance within the district and are applied to those parcels that specifically benefit from the enhanced maintenance and improvements. The assessment rates for FY 2023/24 are projected to increase 7% in conformance with the allowable increase of 5.77% in the Consumer Price Index, All Urban Consumers, for the Los Angeles-Long Beach-Anaheim Area (CPI), from January through January of the previous calendar year plus a catch-up factor of

1.23%. In an effort to relieve the financial burden on property owners, the City waived any increases during the pandemic. With rising maintenance and capital costs, staff is recommending an increase in the FY 2023/24 assessment rates of 7%, which is approximately 97% of the maximum allowable rate.

The attached two resolutions provide the legal mechanism to fund the district for Fiscal Year 2023/24. The first resolution approves, on a preliminary basis, the Assessment Engineer’s Report (which sets the levy by parcel) and initiates the proceedings for next Anaheim Resort Maintenance District Annual Levy and Collection of Assessments May 16, 2023

year’s levy. The second resolution declares the city’s intention for this annual levy and sets a public hearing for June 27, 2023, on this issue.

IMPACT ON BUDGET:

The Fiscal Year 2023/24 levy will generate approximately $5.8 million, which will be deposited into the Anaheim Resort Maintenance District Fund for the operation and maintenance of the district.

Respectfully submitted,
Rudy Emami
Director of Public Works
