CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: MAY 16, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: RIGHT OF WAY CONTRACT-STATE HIGHWAY-PERMANENT

EASEMENT DEED LOCATED AT MIRALOMA WAY CUL-DE-SAC
ATTACHMENT (Y/N): YES ITEM # 12
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion,

1. Approve a Right of Way Contract-State Highway (Agreement) and a Permanent Highway Easement Deed (Easement) and authorize the Mayor and City Clerk to execute the Easement and direct the City Clerk to release the Easement to the California Department of Transportation (Caltrans); and

2. Authorize the acceptance of an $11,400 payment and approve allocating a portion of the payment as reimbursement to Public Works for a right-of-way construction permit (RCP).

DISCUSSION:

Caltrans State Route 91 (SR-91) Improvement Project from State College Boulevard to Lakeview Avenue proposes to widen and make operational improvements, including reconstructing ramps, bridges, and connectors on SR-91. Related to this project, Caltrans is installing a new overhead sign structure between Placentia Avenue and the State Route 57 connector ramp. The sign’s design requires constructing and installing a tubular post and footing foundation on an unimproved portion of East Miraloma Way (Site). The Site is part of a landscaped cul-de-sac owned by the City.

On April 26, 2022, City Council approved a right of entry in favor of Caltrans, enabling them to secure property rights necessary to certify its project. Since then, Caltrans has submitted construction plans to Public Works, and the construction and installation of a new overhead sign is anticipated to begin in June 2023. Caltrans has presented an offer to purchase a highway easement securing property rights for the tubular post, footing foundation, and access rights. The offer is an all-inclusive payment of $11,400 for the fair market value of the City’s property, together with the cost to defray City staff time for plan-checking services and associated inspections for an RCP.

In addition, the Agreement and Easement detail the following terms and conditions:

Right of Way Contract-State Highway-Permanent Easement Located at Miraloma Way Cul-de-sac May 16, 2023

Page 2 of 2 ends

 The overhead sign structure will comply with all public service facilities clearance requirements and protect those facilities in place.
 Existing public service facilities shall maintain prior rights for future maintenance or improvement needs as determined by the City.
 Caltrans will replace “in kind” existing miscellaneous landscaping that may be impacted, damaged, or removed during construction.

IMPACT ON BUDGET:

The payment will be deposited in the General Fund.

Respectfully submitted,
Rudy Emami
Director of Public Works
