ATTACHMENT (Y/N): YES ITEM # 09
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion,
1. Approve the Plumbing Utility Agreements between the City of Anaheim and the following four plumbing contractors:

authorizing all four plumbing contractors to provide various plumbing services, on a non-exclusive basis, to persons at the Convention Center who require such services in connection with events for a two-year term, and may be extended for two additional one-year terms at the city’s sole option; resulting in revenue commissions payable to the City in the amount of 15% of the contractors gross billings for all labor and other work for services performed at the Anaheim Convention Center, of which commission is estimated to be $78,000 annually; and
2. Authorize the Executive Director of the Convention, Sports & Entertainment Department to execute any other related documents, take any and all actions as are necessary to implement and administer the Agreements, and execute any optional renewals.
Agreements between the City of Anaheim and four plumbing contractors May 16, 2023
DISCUSSION:
It has been a long standing practice of the Anaheim Convention Center (Convention Center) to permit licensed contractors to provide various plumbing services, such as compressed air lines, natural gas, water and/or other waste line services, to tenants and their exhibitors who require these services in connection with events held at the Convention Center. For the ability to provide various plumbing services at the Convention Center, the City of Anaheim requires that these contractors pay to the City a commission based on the gross revenues billed for the services that are provided.
The term of the agreement will be from July 1, 2023, through June 30, 2025, may be extended for two additional one year terms, and will require all four plumbing contractors to pay the City of Anaheim fifteen percent (15%) of all gross billings earned from all work performed at the Convention Center.
IMPACT ON BUDGET:
Revenues generated from these Agreements, estimated at $78,000 annually, are used to support Convention, Sports & Entertainment operations.
Respectfully submitted,
Thomas Morton
Executive Director
Convention, Sports & Entertainment Department
