CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: MAY 16, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF

ANAHEIM AND THE CALIFORNIA HIGH-SPEED RAIL

AUTHORITY FOR THE REVIEW AND DEVELOPMENT OF

TECHNICAL ENGINEERING DOCUMENTS SUPPORTING

CALIFORNIA HIGH-SPEED RAIL
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion,
1) Approve the Reimbursement Agreement with the California High-Speed Rail Authority in the amount not to exceed $400,000 for the review and development of technical engineering documents; authorize and direct the Director of Public Works or his designee to execute the agreement and any other related documents which may be necessary in order to implement this Agreement; and 2) Authorize de minimis changes to the Reimbursement Agreement that do not substantially change the terms and conditions as determined by the City Attorney’s Office; and
3) Increase the Public Works FY 2022/23 revenue and expenditure budget in restricted transit grants by $400,000.

DISCUSSION:

The California High-Speed Rail Authority (Authority) is responsible for the planning design, construction, and operation of the first high-speed rail system in the nation.

California’s high-speed rail system will connect the mega-regions of the state, contribute to economic development and a cleaner environment, create jobs, and preserve agricultural and protected lands. When it is completed, high-speed rail will run from San Francisco to the Los Angeles basin in under three hours at speeds of over 200 miles per hour. The system will eventually extend to Sacramento and San Diego (including a stop at ARTIC in the City of Anaheim) totaling 800 miles with up to 24 stations. In addition, the Authority is working with regional partners to implement a statewide rail modernization plan that will invest billions of dollars in local and regional rail lines to meet the State’s 21st century transportation needs.

Reimbursement Agreement:

To facilitate the design and construction of the high-speed rail system, the Authority requires the City to perform various tasks such as reviewing engineering documents, identifying conflicts, coordinating activities, and developing a master agreement for future project phases.

The reimbursement agreement provides a mechanism for the City to recover actual costs incurred up to the budgeted amount of $400,000 for the services provided by the City of Anaheim to the Authority. Costs include both staff time and work performed by consultants, as necessary.

IMPACT ON BUDGET:

This action will increase the Public Works revenue and expense budgets in restricted transit grants by $400,000 in FY 2022/23.

Respectfully submitted,
Rudy Emami
Director of Public Works
