Appendix 5. Permits and Approvals

5.1 Purpose
The purpose of this appendix is to define the responsibilities and allocation of risk between the City (COA) and the Design Build Entity (DBE) regarding obtaining and complying with permits and approvals that are required for the Project.

5.2 Overall Responsibility of the DBE for Obtaining Permits and Approvals
Unless otherwise specified below, the DBE shall act as COA’s agent in obtaining permits and approvals and shall be responsible for obtaining all permits and approvals necessary for design, construction, and operation of the Project.

In connection with these responsibilities, the DBE shall be responsible for performing all supporting studies, including fieldwork and analyses, and for preparing all required documents, including but not limited to 1) all environmental mitigation and monitoring plans required by Project CEQA documents; 2) all studies required to support permit applications; and 3) all studies and work necessary to comply with permit conditions. The DBE shall comply with conditions of all permits and approvals, whether obtained by COA or by the DBE. COA will pay all permit and approval fees regardless of whether the permit or approval is obtained by the City or by the DBE through the prescribe Allowance.

5.3 COA Support for DBE’s Permitting Efforts

5.3.1 General
COA will assist the DBE by providing supporting information for permit applications where that information has been developed by or is readily available to COA. COA will also review permit applications, attend pre-application meetings, and permit hearings if any at the request of the DBE.

5.3.2 COA Efforts to Facilitate Required City of Anaheim Approvals Various departments within the City of Anaheim issue permits and approvals that will be required for construction of the Project. These permits and approvals and the issuing departments are provided.

Even though the Project will be owned and is being sponsored by AF&R, the DBE shall be responsible for obtaining all permits and approvals issued by the Anaheim Department of Public Works, the City of Anaheim Planning Department, and the City of Anaheim Building Division and all other departments within the City of Anaheim. The City Representative (Project/Construction Manager) and AF&R do not have any permitting privileges with other City departments and cannot expedite the permitting process. However, the City Representative (Project/Construction Manager) has, taken a number of steps to facilitate the City permitting and approvals process. This includes holding meetings with the Anaheim Department of Public Works, the City of Anaheim Planning Department, and the City of Anaheim Building Division to discuss the intent of the Project, the overall Design-Build Process, and requirements for application submittals.
