CITY COUNCIL AGENDA REPORT
City of Anaheim

FINANCE DEPARTMENT
DATE: JUNE 13, 2023
FROM: FINANCE DEPARTMENT
SUBJECT: APPROVAL OF AGREEMENT FOR GRAFFITI REMOVAL

SERVICES
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, waive the requirements of Council Policy 4.0 and approve a new agreement with Superior Property Services, Inc., Anaheim, CA (new location), in an amount not to exceed $1,801,440 per year for an initial two-year agreement beginning in July 2023. The agreement includes three one-year optional renewals and authorizes the Purchasing Agent to exercise the renewal options.

DISCUSSION:

Superior Property Services, Inc. (SPS) was initially hired in 2012 to provide citywide graffiti removal services and prevention programs. SPS was selected following a competitive Request for Proposal (RFP) process. SPS has been providing excellent service to the City since that time. Additionally, SPS has been a major sponsor to many diverse organizations and has regularly demonstrated a commitment to giving back to the Anaheim community.

In July 2018, SPS was issued a new two-year agreement to continue providing the services throughout the city. That agreement has been renewed each year since 2020 due to their responsiveness and excellent quality of work. The final renewal term ends in July 2023. Rather than once again issuing an RFP, staff asked SPS to review the current scope of work, consider various service changes, and submit a new proposal.

This approach was taken based on an examination of the marketplace and after a thorough review of SPS’ performance under the current agreement. In order to continue providing services with the same response time and using the latest equipment and products, SPS has requested a one-time increase of 6.9% to the base monthly rate. That rate would be fixed for the initial two-year term.

Staff has evaluated several factors prior to making the recommendation for a new agreement with SPS. The company has performed exceptionally for over 10 years.

They are one of only three companies identified that perform this kind of work for other municipalities in surrounding cities and counties. They have consistently offered very competitive pricing when responding to other proposals. They are now a local vendor headquartered in Anaheim and have for many years participated in a multitude of Approval of Agreement for Graffiti Removal Services

community events. SPS has donated their time and funds to support programs such as Anaheim Goals, Anaheim Beautiful, Anaheim Community Foundation, Rotary Club, and Love Anaheim. They regularly contribute and participate in annual events such as 4th of July, the Christmas Tree Lighting, Veterans Day, and Flag Day. Over the term of the recent agreement SPS donated hundreds of gallons of paint to groups along with the use of paint sprayers and assistance to complete “paint out” projects.

Based on the continued efforts to minimize cost increases and the added value of the ancillary services readily offered throughout the community, plus the outstanding support given to city staff, it is the recommendation that Council authorize entering into a new two-year agreement with SPS. Pricing for the renewal periods shall be negotiated each year with any increases not-to-exceed the change in the Consumer Price Index (CPI) as outlined in the agreement.

IMPACT ON BUDGET:

Funding for this Agreement has been included in the proposed Planning & Building Department Fiscal Year 2023/24 General Fund Budget, which will be up for Council consideration this month. Funding for subsequent years will be subject to Council’s approval of budget appropriations.

Respectfully submitted, Concurred by,
Barrick L. Bartlett Ted White
Purchasing Agent Planning & Building Director
