CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 13, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: JOINT PARTICIPATION AGREEMENT WITH THE CITY OF FULLERTON FOR THE BROOKHURST ROAD AT SR-91 STREET
REHABILITATION
ATTACHMENT (Y/N): YES ITEM # 17
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve the Joint Participation Agreement (Agreement) between the City of Anaheim and City of Fullerton, in an amount not to exceed $173,413.50, for the construction, inspection, and administration of the Brookhurst Road at SR-91 street rehabilitation, and direct and authorize the Director of Public Works or designee, on behalf of the City of Anaheim, to execute the Agreement and any related documents, and to take any and all actions as are necessary to implement and administer the Agreement.
DISCUSSION:
The City of Fullerton (Fullerton) is constructing the Brookhurst Road Rehabilitation Project from the State Route 91 East off and on ramps to Page Avenue (Project). Since only a small portion of the project at the south end is within the City of Anaheim (Anaheim), it will be more efficient and minimize the inconvenience to the traveling public, if Fullerton rehabilitates the Anaheim portion of the roadway at the same time.
The work consists of resurfacing and reconstructing the asphalt concrete pavement, adjustments of utility structures, signing, striping, and other miscellaneous items of work.
The entire Project cost is estimated at $504,921. Anaheim’s pro-rata share in the project is estimated at $173,413.50, or around 34.3% of the total Project cost, for the project design and construction costs for the work within the City of Anaheim boundary. Anaheim will reimburse Fullerton its pro-rata share of the actual cost within 45 days of being invoiced.
This Joint Participation Agreement between Anaheim and Fullerton outlines the respective roles and responsibilities and stipulates that Fullerton will be the lead agency for the design, environmental, construction, and administration of the Project.
Construction is anticipated to start in the summer of 2023 and should be completed during the Fall of 2023.
Joint Participation Agreement with the City of Fullerton for the Brookhurst Road at SR-91 Street Rehabilitation June 13, 2023
ENVIRONMENTAL DETERMINATION:
In accordance with the California Environmental Quality Act (CEQA) (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), Fullerton, as Lead Agency is required to determine if the Project is exempt from CEQA.
The Joint Participation Agreement establishes Fullerton as the Lead Agency. Fullerton recommended that the Project is Categorically Exempt from CEQA pursuant to Class 1, Sections 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination.
IMPACT ON BUDGET:
Adequate funding is available in restricted transportation and Sewer Utility Adjustment funds in the Public Works Department’s FY 2022/23 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
