CITY COUNCIL AGENDA REPORT
City of Anaheim
HUMAN RESOURCES DEPARTMENT
DATE: JUNE 13, 2023
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: APPROVAL OF A LETTER OF UNDERSTANDING BETWEEN
THE CITY OF ANAHEIM AND THE ANAHEIM POLICE
MANAGEMENT ASSOCIATION MODIFYING THE DECEMBER
27, 2019 THROUGH JUNE 30, 2025 MEMORANDUM OF
UNDERSTANDING TO AUTHORIZE COMPACTION PAY
ADJUSTMENTS AS NEGOTIATED UNDER A REOPENER
PROVISION
ATTACHMENT (Y/N): YES ITEM # 19
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Resolution, approve a Letter of Understanding (LOU) between the City of Anaheim (City) and the Anaheim Police Management Association (APMA), authorizing adjustments to address compaction under the negotiated terms of a reopener provision in the December 27, 2019 through June 30, 2025 Memorandum of Understanding between the City and the APMA.
DISCUSSION:
The Memorandum of Understanding (MOU) between the City and the APMA was adopted on September 28, 2021 to establish wages, benefits, and other terms and conditions of employment for employees represented by the APMA.
The unit represents 20 employees within the classifications of Police Captain and Police Lieutenant. Police Captains are responsible for administrative management level duties in the Police Department while Police Lieutenants oversee bureau management. The typical line of internal promotion into these classifications follows the progression from Police Officer to Police Sergeant to Police Lieutenant to Police Captain.
The adopted MOU included substantive provisions that focused primarily on correcting salary compaction between subordinate ranks and the Police Lieutenant and Police Captain classifications. The current MOU phased in salary restructuring and other salary adjustments to the Police Lieutenant and Police Captain classifications. In addition, the MOU included a reopener provision in January 2023 for the sole purpose of addressing compaction issues expected to arise as a direct result of the July 2023 implementation of longevity pay under the Anaheim Police Association’s current MOU, providing eligible Approval of a Letter of Understanding Between the City of Anaheim and the Anaheim Police Management Association Modifying the December 27, 2019 through June 30, 2025 Memorandum of Understanding to Authorize Compaction Pay Adjustments as Negotiated Under a Reopener Provision
June 13, 2023
employees in the Police Officer or Police Sergeant classifications longevity pay of five percent (5%) of base pay. This additional pay for Police Sergeants at the top step will significantly decrease or eliminate pay differentials between Police Sergeant and Police Lieutenant, eliminating the compaction corrections achieved with the prior MOU.
The City and the APMA met and conferred and agreed to the following for represented classifications:
Effective June 23, 2023, the City shall provide a base salary increase of three percent (3%) for APMA classifications.
Effective June 21, 2024, the City shall provide a base salary increase of two percent (2%) for APMA classifications.
The proposed adjustments are in addition to the existing MOU rates between the City and the APMA. This recommended action will provide equitable pay and salary differentials among sworn law enforcement classifications.
IMPACT ON BUDGET:
The cost of the recommendation is estimated to be $280,000 in FY 2023/24 and $481,000 for the remainder of the contract term. Law enforcement salaries are funded entirely through the the General Fund. The Police Department has sufficient funds to support the recommendation.
Respectfully submitted,
Linda N. Andal
Human Resources Director
