CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 27, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: ADOPTION OF AN ORDINANCE ADDING CHAPTER 10.13 TO TITLE 10 OF THE ANAHEIM MUNICIPAL CODE

ESTABLISHING STORMWATER CREDIT PROGRAM (SECOND

READING)
ATTACHMENT (Y/N): YES ITEM # 22
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, adopt an Ordinance adding Chapter 10.13 (Stormwater Credit Program) of Title 10 (Public Services and Utilities) of the Anaheim Municipal Code establishing the Anaheim Stormwater Credit Program (Program); and determine that the adoption of the Ordinance and Credit Price is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines.

DISCUSSION:

On June 13, 2023, the City Council introduced the subject Ordinance adding Chapter

10.13 to Title 10 of the Anaheim Municipal Code establishing the Anaheim Stormwater Credit Program (Program). A summary of the Program and the additions to the Municipal Code are attached in the June 13, 2023 City Council Staff Report (Attachment 2). If adopted the Ordinance will become effective thirty (30) days after adoption by City Council.

ENVIRONMENTAL DETERMINATION:

Staff recommends that the City Council determine that the proposed Ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines. This determination is based on the fact the proposed fees will not result in a direct or reasonably foreseeable indirect physical change in the environment and it is not a project as defined in Section 15378.

IMPACT ON BUDGET:

Revenue from a stormwater credit program will be included in the Public Works Stormwater Credit Program Fund.
