CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 27, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: RESOLUTION SETTING THE STORMWATER CREDIT

PROGRAM CREDIT PRICE
ATTACHMENT (Y/N): YES ITEM # 28-J
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, following a public hearing, by Resolution, establish the Anaheim Stormwater Credit Program Credit Price and add said Credit Price to the Public Works Fee Schedule.

DISCUSSION:

On June 13, 2023, the City Council introduced an Ordinance adding Chapter 10.13 to Title 10 of the Anaheim Municipal Code establishing the Anaheim Stormwater Credit Program (Program). A summary of the Program and the additions to the Municipal Code are attached in the June 13, 2023 City Council Staff Report (Attachment 2). If adopted the Ordinance will become effective thirty (30) days after adoption by City Council.

The Program provides public and private projects the opportunity to purchase stormwater credits (Credits) allowing for offsite stormwater treatment, rather than treating stormwater on site. By this Resolution, the City is setting the Credit Price which allows interested parties’ (Credit Users) to voluntarily participate in the Program.

The Credit Price is based on the actual cost for design and construction of the Credit Generator as well as the projected cost for operation and maintenance. This is detailed in the attached Stormwater Credit Price Study (Attachment 3). When a new Credit Generator is constructed or economic conditions change significantly, a revision to the Stormwater Credit Price Study will be completed to determine the new Credit Price, which will be presented to City Council for review and approval. The credit price is $32.79/Credit for Anaheim Bay Watershed and $26.88/Credit for the Santa Ana River Watershed.
