DEPARTMENT OF PUBLIC WORKS
DATE: JULY 11, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONTRACT FOR THE SANTA ANA CANYON

ROAD SOUTH SLOPE REPAIR AND STORM DRAINAGE

IMPROVEMENTS EAST OF LAKEVIEW AVENUE
ATTACHMENT (Y/N): YES ITEM # 05
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, award the contract (Contract) to the lowest responsible bidder, ACE Capital Engineering of Lake Forest, CA, Contractor’s License No. 1061931, Classifications A, B, and C-7, in the amount of $189,950.83, for the Santa Ana Canyon Road South Slope Repair and Storm Drainage Improvements East of Lakeview Avenue (Project); authorize and direct the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; authorize and direct the Director of Finance to execute the Escrow Agreement pertaining to contract retentions; and determine that the Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the California Code of Regulations.

DISCUSSION:

The bids are summarized as follows:

1. ACE Capital Engineering, Lake Forest, CA…..………….………………$189,950.83

2. Voltaire Engineering, Redlands, CA…………………….………………..$214,453.00

3. Sol Construction, Inc., Riverside, CA…………………………...….……$253,858.00

4. HZS Engineering and Construction, Santa Ana, CA……..……………….$257,366.00

5. US Builders & Consultants, Anaheim, CA……………………………….$338,490.00 This Project will address the ongoing concerns of drainage and slope failure on a portion of the south side of Santa Ana Canyon Road, east of Lakeview Avenue. The work will improve safety in the area and reduce operational maintenance costs by constructing a slope retention system and directing storm water into an existing catch basin.

The bid price is lower than the engineer’s estimate, appears to be reasonable, and is within available funding. Liquidated damages for this Project shall be $1,000 per calendar day.

Construction is scheduled to begin in the summer and should be completed in the fall.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 3, Section 15303 (d) (New Construction) of Title 14 of the CCR which consists of construction and location of limited numbers of new, small facilities or structures and specifically exempts water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the Project List.

The Project List (Attachment F to the CWA) as approved by City Council identifies projects in which the CWA shall apply. In determining project application, the CWA Project List was based on the Capital Improvement Program that may be adjusted annually based on City priorities, availability of funding, and other considerations. The intent in the development of the Project List is that larger projects be included due to the additional administrative activities associated with the CWA and minimize the impact of the additional administrative functions and costs for the City and for smaller construction firms.

IMPACT ON BUDGET:

Adequate funding is available in the Fiscal Year 2023/24 Public Works Department’s Wastewater Fund budget.

Respectfully submitted,
Rudy Emami
Director of Public Works
