CITY COUNCIL AGENDA REPORT
City of Anaheim

POLICE DEPARTMENT
DATE: AUGUST 15, 2023
FROM: POLICE DEPARTMENT
SUBJECT: AGREEMENT TO PROVIDE AIR SUPPORT SERVICES AT AN

HOURLY RATE FOR THE CITY OF IRVINE
ATTACHMENT (Y/N): YES ITEM # 16
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve the agreement with the City of Irvine for Anaheim to provide air support services at an hourly rate of $1,058 for a term beginning on July 1, 2023 and ending on June 30, 2025, with three one-year optional renewals; and authorize the Chief of Police, or designee, to take any and all actions necessary to implement and administer the agreement on behalf of the City.

DISCUSSION:

Currently, there are three agencies in Orange County with dedicated law enforcement air support services for the areas they serve: the Anaheim Police Department, Huntington Beach Police Department, and the Orange County Sheriff’s Department. Orange County law-enforcement agencies without these resources can request and receive air support assistance based on aircraft availability among these three agencies. Different arrangements have existed over the years in Orange County wherein air support resources have been consolidated, and some agencies have elected to contract for these services. The contracts for such services vary from hourly, as-needed rates to dedicated patrol flight time. A contract provides the contracting city priority for services, and allows for an hourly rate cost reimbursement to the agency supplying the service.

The City of Irvine has approached the Anaheim Police Department (APD) for such an arrangement and APD is requesting approval to enter into an agreement with the City of Irvine to provide air support services on an as-needed basis. Dependent upon aircraft and crew availability, and with the understanding that the needs and demands in Anaheim are the priority, this agreement provides for an on-duty, available APD aircraft, and crew at the hourly rate of $1,058.00. The proposed hourly rate is inclusive of personnel, maintenance, and fuel. “As needed” will include requested assistance on emergencies in progress, calls for service, and/or planned events. Irvine is not requesting dedicated patrol flight hours in this contract.

Air Support offers a substantial enhancement to our policing effort, and the ability to deliver those capabilities more broadly throughout the county will serve to enhance Agreement to Provide Air Support Services at an Hourly Rate for the City of Irvine August 15, 2023

public safety across the region. The 2018 Orange County Grand Jury Report examining public agency helicopter operations identified the significant expenses incurred by the Air Support operators in the county, finding that consolidation of air resources as in other nearby counties could lead to greater efficiency. While the proposed agreement is by no means a form of consolidation, it will serve as a vehicle to recover costs when assisting other jurisdictions.

IMPACT ON BUDGET:

All costs incurred from this agreement will be offset by revenues paid by the City of Irvine. The proposed hourly rate is inclusive of personnel, maintenance, and fuel expenses.

Respectfully submitted,
Jorge Cisneros
Interim Chief of Police
