HOUSING AUTHORITY AGENDA REPORT
City of Anaheim

HOUSING & COMMUNITY DEVELOPMENT

DEPARTMENT
DATE: AUGUST 15, 2023
FROM: HOUSING & COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: PROFESSIONAL SERVICES AGREEMENTS FOR ON-CALL

PROFESSIONAL ENVIRONMENTAL SERVICES
ATTACHMENT (Y/N): YES ITEM # 01
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the Governing Board of the Anaheim Housing Authority, by Motion, approve individual Professional Services Agreements, substantially in the forms attached, between the Anaheim Housing Authority (Authority) and the following consultants for on-call environmental services to support current and future Housing and Community Development Department (Department) activities: The Converse Professional Group, Dudek, EFI Global, Inc., Leighton and Associates, Inc., Ninyo & Moore Geotechnical & Environmental Sciences Consultants, and Pacific Edge Engineering, Inc., each in an amount not to exceed $200,000 per term, for a term ending June 30, 2024, with two additional two-year extensions in a total amount not to exceed $600,000; and authorize the Executive Director of the Anaheim Housing Authority, or her designee, to execute, implement, and administer the agreements on behalf of the Authority; and authorize de minimis changes that do not substantially change the terms and conditions of the Agreements, as determined by the City Attorney’s Office.

DISCUSSION:

In February 2022, the Anaheim Housing Authority and the City of Anaheim (City) released a Requests for Proposals (RFP) soliciting on-call environmental services, including Phase I and Phase II assessments, remedial action plans, and remediation services.

Eleven firms submitted responses to the RFP. In accordance with the qualifications- based selection procurement specified in City Council Policy No. 4.1, the Department established a review panel consisting of staff from Economic Development, Public Utilities, and Housing and Community Development. The firms were evaluated based on overall experience, services available, and familiarity with relevant environmental regulations. The review panel also evaluated each firm’s proposed fees for such services.

A rating system was used to determine the most responsive proposals. The top six firms Professional Services Agreements for On-Call Environmental Services August 15, 2023

were recommended and approved at the May 24, 2022, City Council meeting. In July 2022, agreements were created between the City and the six environmental consultants.

However, now the Authority is requesting the approval for new agreements to be created between the Authority and the six environmental consultants.

The Authority has numerous projects underway that will require environmental services.

Projects requiring environmental work include remediation of the properties at the southeast corner of Beach Boulevard and Lincoln Avenue, Elm Street site assessment and remediation, Anaheim Boulevard site assessment, northwest corner of Santa Ana and Lemon Street site assessments, and future acquisitions supporting affordable housing and Housing and Community Development Department activities throughout the City of Anaheim.

These agreements will ensure uninterrupted implementation of the current projects in the pipeline and future projects as needed.

It is noted that the City of Anaheim has similar contracts with several of the environmental consultants identified herein however, given that the Housing Authority is a separate legal entity and relies on restricted State and Federal grants to accomplish much of its work, the City Attorney’s Office recommended contracts be established specifically with the Anaheim Housing Authority.

IMPACT ON BUDGET:

Sufficient funds for these agreements are available in the Housing and Community Development Department Fiscal Year 2023/2024 budget. Funding for subsequent years will be subject to Council’s approval of budget appropriations.

Respectfully submitted,
Grace Ruiz-Stepter
Executive Director of Anaheim Housing Authority
