CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: AUGUST 29, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONTRACT FOR CATCH BASIN SCREEN
INSTALLATION – PHASE 3 (2022)
ATTACHMENT (Y/N): YES ITEM # 10
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion:

1. Determine that the Catch Basin Screen Installation Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b) of Title 14 of the California Code of Regulations;

2. Award the Contract to the lowest responsible bidder, G2 Construction, Inc. of Santa Ana, California, Contractor’s License No. 801253, Classifications A, C8, and C60, in the amount of $509,895 for the proposed Project; authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct the Director of Finance to execute the Escrow Agreement pertaining to contract retentions.

DISCUSSION:

There are approximately 2,500 catch basins in Anaheim that fall under the requirements of the Trash Provisions program. The trash capture screens, also known as Connector Pipe Screens (CPS), prevent trash and other debris from being carried downstream in the storm drain system, aiding collection by the Public Works Operations Division. This project consists of retrofitting approximately 373 storm water catch basins citywide with CPS; this will include survey and measurements of all catch basin locations, fabrication of the CPS trash capture devices, traffic control, and installation of the CPS devices.

As a result of grant funding received through previous rounds of OCTA’s Measure M2 Environmental Clean-up Program, the City has been able to install 1,441 CPS devices or a little over 57%. With the 2022 round of funding from OCTA, this third phase will consist of installing an additional 373 devices, allowing the City to achieve 70% compliance.

One bid was received from a list of prequalified contractors under OCTA’s authorized Regional Cooperative Agreement. The bid price of $509,895 is lower than the engineer’s estimate of $549,366, reflects the current bidding environment and is within the available funding.

Construction is scheduled to begin in late Summer 2023 and is expected to be completed in Fall 2023. Liquidated damages are set at $800 per day.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 2, Section 15301 (b) of Title 14 of the CCR which consists of replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.

After determining that this Project is categorically exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision
COMMUNITY WORKFORCE AGREEMENT (CWA):

This project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the Projects List (Attachment F to the CWA).

Additionally, the size and scope of this project do not meet the definition of “Project Work” as defined in the CWA; therefore, this project is exempt.

IMPACT ON BUDGET:

Sufficient restricted funds are available in the Public Works Department Fiscal Year 2023/24 Measure M2 Fund Budget and Wastewater Fund to cover both the project cost and the required 20% matching funds for this OCTA Grant.

Respectfully submitted,
Rudy Emami
Director of Public Works
