CITY COUNCIL AGENDA REPORT
City of Anaheim

HUMAN RESOURCES DEPARTMENT
DATE: AUGUST 29, 2023
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: ADOPTION OF A MEMORANDUM OF UNDERSTANDING

BETWEEN THE CITY OF ANAHEIM AND THE INTERNATIONAL
BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 47,

PROFESSIONAL MANAGEMENT UNIT AND PART-TIME

MANAGEMENT UNIT
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Resolution, adopt a Memorandum of Understanding (“MOU”) establishing the terms and conditions of employment for classifications represented by the International Brotherhood of Electrical Workers, Local 47 (“IBEW”), Professional Management Unit and Part-Time Management Unit, effective, January 20, 2023 through January 15, 2026.

DISCUSSION:

The IBEW Professional Management and Part-Time Management Units represent approximately 70 full-time employees and 3 part-time employees serving in the Anaheim Public Utilities and Public Works Departments. Classifications within the unit include those such as Real Property Analyst, SCADA Systems Analyst, Assistant Power Engineer, Associate Transportation Planner, Principal Civil Engineer, Senior Electric Systems Designer, and Principal Power Systems Planning Engineer.

After months of negotiations, the City and IBEW reached tentative agreement on August 16, 2023. IBEW membership ratified the tentative agreement on August 18, 2023.

Substantive provisions in the proposed MOU reflecting the tentative agreement include the following:
 Three-year term ending January 15, 2026
 Across-the-board increases of five percent (5.0%) effective the pay period beginning January 20, 2023, four percent (4.0%) effective January 19, 2024, and four percent (4.0%) effective January 17, 2025
 Increase to the salary range maximums (from 115% of Market to 120% of Market) effective September 1, 2023
 Increase to the City’s contribution to Retiree Health Savings from 2% of base pay to 3% of base pay in January 2025

 Increase to Temporary Upgrade Pay after 29 consecutive work shifts (from 7.5% of base pay to 10% of base pay)
 Increases to Bilingual Pay, and Safety Boot Reimbursement  Increase in paid Administrative Day from two days per year to three days per year (no cash value to the employees and must be used within the calendar year)  Amendments to the grievance procedures
 Updates to rules for
o Standby pay
o Bereavement Leave
o Layoff, Reassignment, Reemployment, Reinstatement, Voluntary Demotion
 Newly added Articles – primarily reflecting current practices o Personnel Files
o Professional Licenses and Education
o Sick Leave for part-time employees
o Travel and Mileage reimbursement
Additional changes reflected in the attached track changes copy of the MOU reflect updates to language, clarification of provisions, and deletions of outdated provisions.

The changes in the proposed MOU are expected to significantly improve the City’s ability to recruit and retain top talent for the specialized professional management classifications represented by these units. Employees in these positions are key to ensuring the ability of the departments to develop plans, design upgrades and expansions, and perform project management related to the electric and water utilities, sewer, storm drain and traffic systems, and related technology systems. Approximately 25% of employees in the IBEW management represented classifications have less than five years of service with the City.

There is a ten percent (10%) vacancy rate in the budgeted positions for represented classifications.

IMPACT ON BUDGET:

The impact of the MOU changes is approximately $4,343,888 over the three-year term, including $1,479,775 for Fiscal Year 2023/2024, of which nearly 20% is General Fund.

There are sufficient budget appropriations in the Departments’ FY 2023/24 budgets to accommodate the costs associated with this MOU.

Respectfully submitted,
Gretchen R. Beatty
Acting Human Resources Director
