The work to be undertaken at 233 E. Center Street parking structure consists of the installation of nine (9) new public ChargePoint chargers and the work at 1150 N. Kraemer Boulevard consists of the installation of six (6) new fleet ChargePoint chargers. Project scope includes additional appurtenant work such as slab restoration and electrical sub panel upgrades.

The project will increase public access to EV charging, as well as support the increased use of EVs for fleet purposes. This project is funded by the State of California’s Low Carbon Fuel Standard (LCFS) program that promotes zero-emission vehicle proliferation.

The bid price reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this project shall be $500 per calendar day. Construction is estimated to be completed by October 2024 due to long lead procurement for certain electrical equipment.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the CCR which consists of constructing utility systems and/or facilities involving negligible or no expansion of capacity.

After determining that this Project is categorically exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the “Projects List”.

The Project List (Attachment F to the CWA) as approved by City Council on December 3, 2019 identifies projects in which the CWA shall apply. In determining project application, the CWA Project List was based on the Capital Improvement Program that may be adjusted annually based on City priorities, availability of funding, and other considerations. The intent in the development of the Project List is that larger projects be included due to the additional administrative activities associated with the CWA and minimize the impact of the additional administrative functions and costs for the City and for smaller construction firms.

IMPACT ON BUDGET:

Sufficient funds are available in the Anaheim Public Utilities’ Fiscal Year 2023/24 restricted Electric Utility fund budget, utilizing LCFS State funding.
