HOUSING AUTHORITY AGENDA REPORT
City of Anaheim
HOUSING & COMMUNITY DEVELOPMENT
DEPARTMENT
DATE: SEPTEMBER 12, 2023
FROM: HOUSING & COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR TO
EXECUTE AND ADMINISTER LICENSES AND RIGHT OF ENTRY
AGREEMENTS
ATTACHMENT (Y/N): YES ITEM # 01
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the Governing Board of the Anaheim Housing Authority, by Resolution, authorize the Executive Director to execute and administer Licenses and Right of Entry agreements, each with a term not to exceed one year, allowing for temporary beneficial use of real property assets until such time as these properties are ready for disposition or development.
DISCUSSION:
The Anaheim Housing Authority (AHA) serves as the City agency responsible for the provision of quality, affordable housing in Anaheim. Following the dissolution of the Anaheim Redevelopment Agency, the AHA accepted the housing assets and responsibilities of the former Redevelopment Agency.
The housing assets held by AHA are all slated to be developed to assist income qualified families through the provision of sanitary, safe, and quality affordable housing.
While it is the goal of staff to facilitate development of all sites held for affordable housing production expeditiously, securing all necessary funding and land entitlements can be a lengthy process. As a result, it can take several years for some assets to advance to the development phase. From time to time, the AHA receives requests to use vacant land and/or properties to assist with other City related activities. For example, in the past, sites have been used to store construction materials and/or equipment needed for public works projects. Similarly, sites have been used to temporarily store equipment used in support of some of the City’s larger conventions. Requests for temporary use may also come from private parties.
Resolution Authorizing Executive Director to Execute and Administer Licenses and Right of Entry Agreements September 12, 2023
Given that the requests to use these real property assets is temporary in nature and are a productive use of the property, staff seeks authorization allowing the Executive Director to execute and administer the Licenses and Right of Entry Agreements, each with a term not to exceed one year, allowing for the temporary use of such real property assets.
The attached Resolution provides for the requested authorization and includes provisions ensuring that the license can be reasonably terminated without cause, indemnity and insurance provided as determined by the City’s Risk Manager, reasonable license fees as determined by the Executive Director, and approval of the form of the license agreement by the City Attorney’s Office. If the proposed use of the real property is for the benefit of a City of Anaheim department, project or program, the Executive Director may waive the license fee.
A list of properties held by the AHA is attached.
IMPACT ON BUDGET:
License agreements providing for the payment of a reasonable license fee will result in monies being deposited into the Low- and Moderate-Income Asset Fund administered by the Housing and Community Development Department and used to assist with ongoing property management costs.
Respectfully submitted,
Grace Ruiz-Stepter
Executive Director of the
Anaheim Housing Authority
