CITY COUNCIL AGENDA REPORT
City of Anaheim

HUMAN RESOURCES DEPARTMENT
DATE: SEPTEMBER 26, 2023
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: APPROVAL OF A RETIRED ANNUITANT PRIOR TO THE
180-DAY WAITING PERIOD TO FILL A CRITICALLY NEEDED

POSITION IN THE COMMUNITY SERVICES DEPARTMENT
ATTACHMENT (Y/N): YES ITEM # 28
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Resolution, certify the critical need for an extra help position within the Community Services Department, waive the statutory 180-day waiting period for post-retirement appointment of a CalPERS annuitant, and approve the appointment of Robert Gomes as an extra help retired annuitant.

DISCUSSION:

Pursuant to the California Public Employees’ Pension Reform Act of 2013 (“PEPRA”), a person who retires from a public employer may serve without reinstatement from retirement or loss or interruption of benefits for up to 960 hours in a fiscal year. The retired person shall not be eligible to be employed in an extra help position for a period of 180 days following the date of retirement unless an employer certifies that the appointment is necessary to fill a critical need before 180 days have passed, and the appointment has been approved by the governing body of the employer in a public meeting.

Robert Gomes retired on July 7, 2023, after 16 years of service in the classification of Park Services Superintendent. Mr. Gomes was responsible for conducting oversight and administration of the central, north central, and east area of the Parks Division consisting of over 40 city parks containing athletic fields, nature areas, skate parks, stadiums, and dog parks for the Community Services Department. He was also in charge of developing, monitoring, and administering the Parks Division operating budget and managing the Parks Division urban forest program.

The City is currently engaged in several critical projects requiring continuous oversight.

Utilizing Mr. Gomes’ expertise to supplement the work of permanent staff will ensure the ongoing safety of parks and the ability of staff to maintain progress on critical projects. Approval of the resolution will authorize the appointment of Robert Gomes as an extra help retired annuitant to provide project leadership for the following special projects: fire clearance for the 2023 fire season; playground replacement at Paul Revere, Approval of a Retired Annuitant prior to the 180-day waiting period to fill a critically needed position in the Community Services Department

Canyon Rim, and Riverdale parks; athletic field renovations at Boysen, Lincoln, and Delphi Parks; central irrigation system upgrades at Citrus, Colony, Edison, George Washington, John Marshall, La Palma, Little Peoples, Manzanita, Pearson, and Walnut Grove Parks; trail upgrade at Anaheim Wetlands and throughout east Anaheim; restroom replacement at Rio Vista Park; and new park installation in Central Anaheim. Mr.

Gomes’ 16 years of experience and expertise in managing projects of a similar nature as well as the various certifications he holds, including certified arborist and pest control advisor, qualify him for assignment to these duties.

Mr. Gomes will be paid an hourly rate of $64.14, consistent with his rate of pay prior to retirement. His extra help assignment will continue for a period not to exceed one year and subject to a maximum of 960 work hours in a fiscal year.

IMPACT ON BUDGET:

Sufficient funds are available in the Community Services Department Fiscal Year 2023/24 budget.

Respectfully submitted, Concurred by,
Gretchen R. Beatty Sjany Larson-Cash
Acting Director of Human Resources Director of Community Services Attachment:
