CITY COUNCIL AGENDA REPORT
City of Anaheim

FINANCE DEPARTMENT
DATE: SEPTEMBER 26, 2023
FROM: FINANCE DEPARTMENT
SUBJECT: ACCEPTANCE OF BID FOR BACKFLOW PREVENTION

DEVICE INSPECTION AND REPAIRS
ATTACHMENT (Y/N): NO ITEM # 04
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, accept the bid from Axis General Construction, Inc., in the amount of $295,650 plus a 20% contingency, for city-wide inspections and repairs of backflow devices for a one-year period, with four optional one-year renewals; and authorize the Purchasing Agent to execute the renewal options, all in accordance with Bid #9705.

DISCUSSION:

Purchasing solicited bids from known contractors and posted the bids on the City’s bid portal. Sealed bids were received by 2:00 p.m., August 30, 2023, from the following contractors and were publicly opened immediately thereafter.

Bidder As Bid Total Revised Bid Atlas Backflow, Inc. $ 244,000.00 $ 244,000.00* Signal Hill, CA
Axis General Construction, Inc. $ 215,615.00 $ 295,650.00** Anaheim, CA
Coast 2 Coast Plumbing, Inc. $ 1,409,488.50 $ 697,488.50** Anaheim, CA
*This bid was deemed non-responsive due to the omission of materials costs in flat rate repairs as requested in bid documents.
** The materials line on the bid noted an estimated annual expenditure of $80,000 and asked bidders to note their markup in the form 1.15 for 15% as an example to properly calculate the materials cost. Axis General utilized a fifteen percent markup at .15 and Coast to Coast noted a ten percent markup at 10. Both bids were corrected with 1.15 and 1.10 respectively to get the revised bid amounts. Atlas noted the markup correctly.

Acceptance of Bid for Backflow Prevention Device – Inspect and Repair September 26, 2023

Page 2 of 2 ends

Backflow prevention devices allow water to flow in a single direction. Proper maintenance of these critical devices is essential to ensure that they are efficiently functioning up to the proper standards. This bid was based on annual testing and as- needed repairs. These services will be performed on over 700 backflow prevention devices of various sizes located throughout the City. The services consist of visual and mechanical inspections of backflow equipment, maintenance and calibration of gauges, testing and certification including reports, as well as the performance of repairs if needed.

The initial term of the agreement will be for a one-year period with up to four one-year optional renewals. Pricing is fixed for the initial one-year base period and shall be negotiated each year of the renewal periods with any increases not-to-exceed the change in the Consumer Price Index (CPI) for the Los Angeles, Long Beach, and Anaheim areas for the preceding 12-month period.

A 20% contingency is recommended to cover any newly added devices and unforeseen repair requirements that may arise during the administration of this agreement.

IMPACT ON BUDGET:

Sufficient funds are available in the Public Works Department Fiscal Year 2023/24 budget. Funding for subsequent renewals will be subject to Council’s approval of budget appropriations.

Respectfully submitted, Concurred by,
John Vasquez Rudy Emami
Acting Purchasing Agent Director of Public Works
