CITY COUNCIL AGENDA REPORT
City of Anaheim
PLANNING AND BUILDING DEPARTMENT
DATE: SEPTEMBER 26, 2023
FROM: PLANNING AND BUILDING DEPARTMENT
SUBJECT: ESTABLISHMENT OF ADMINISTRATIVE REGULATIONS AND
FEES FOR NONEXCLUSIVE TAXI FRANCHISES
ATTACHMENT (Y/N): YES ITEM # 30
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, following a public hearing, take the following actions:
1) Determine that the proposed actions are not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines because they will not result in a direct or reasonably foreseeable indirect physical change in the environment and are not a “project,” as that term is defined in Section 15378 of the State CEQA Guidelines;
2) By Ordinance, amend Sections 4.73.010, 4.73.080, 4.73.100, 4.73.160, and 4.73.190 of Chapter 4.73 of Title 4 of the Anaheim Municipal Code relating to nonexclusive taxicab franchises; and
3) By Resolution, establish Taxicab Program Administrative Regulations and associated fees relating to taxicab franchises.
DISCUSSION:
The City of Anaheim previously had an interagency agreement with the Orange County Transportation Authority (“OCTA”) in which the City agreed to participate in the Orange County Taxi Administrative Program (“OCTAP”), and OCTA agreed to provide the staff and administrative services necessary for the City to comply with State law. Due to changes in the private transportation marketplace that have reduced the use of taxicabs, OCTAP has ceased operations. As a result, the city is required to provide regulatory oversight and administrative services for the two taxicab franchises operating in the City in order to comply with State law.
The proposed amendments to Chapter 4.73 eliminates references to OCTAP and adds a Establishment of Administrative Regulations and Fees for Nonexclusive Taxi Franchises September 26, 2023
new subsection granting the Code Enforcement Manager the authority to adopt Taxicab Administrative Regulations to replace the regulations previously provided by OCTAP. The proposed Taxicab Administrative Regulations institute basic safety and service benchmarks for taxicab companies and drivers and establishes procedures to effectively manage processes involved in issuing permits and decals for taxicab companies, vehicles, and drivers. The proposed Taxicab Administrative Regulations are attached to the resolution as Exhibit A. The resolution also establishes a fee schedule for taxicab franchises and drivers, to allow the City to recoup costs associated with administering the Taxicab Administrative Regulations.
IMPACT ON BUDGET:
There is no impact to the City’s General Fund. Costs associated with administering the administrative regulations will be covered by the proposed fees.
Respectfully submitted,
Ted White
Director of Planning and Building
