CITY COUNCIL AGENDA REPORT
City of Anaheim
CITY MANAGER’S OFFICE
DATE: SEPTEMBER 26, 2023
FROM: CITY MANAGER’S OFFICE
SUBJECT: OVERVIEW OF THE CITY’S TICKET DISCLOSURE POLICY ATTACHMENT (Y/N): YES ITEM # 26
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDED ACTION:
That the City Council receive information regarding the City of Anaheim’s Ticket Disclosure policy with the possibility of directing staff to make changes to the policy.
DISCUSSION:
At the August 29, 2023 City Council meeting, the City Council set a schedule to discuss possible reforms related to the JL Group’s independent investigation into campaign contributions. As a part of that request, the City Council directed staff to provide more information on the City’s Ticket Disclosure Policy along with the possibility of reforms, including creating a better online searchable database for distributed tickets and a refund of the value of tickets if there is a violation of the policy.
The Ticket Disclosure Policy and Ticket Disclosure form can be found on the City’s website. The Ticket Disclosure Policy makes the City Manager the Ticket Administrator for the purposes of implementing the provisions of the policy. As such, the City Manager may issue tickets to City Officials in accordance with sections 5.1, 5.2, and 5.3 in the attached Ticket Disclosure Policy. Tickets that are distributed in accordance with sections 5.2 and 5.3 require a Fair Political Practices Commission (FPPC) form 802 to be filled out and posted publicly. A list of FPPC 802s, along with filled out copies of the form, can be found on the City’s website.
With regard to the refund of the Value of tickets if used improperly, section 4.4 allows the ticket administrator to revoke or suspend ticket privileges of any person who violates any provision of the policy. The policy does not state that violators must refund the value of the tickets.
The policy was most recently updated by the City Council at its meeting on February 9th, 2021. The changes were made to reflect updates to FPPC regulations that specify the criteria necessary for a ticket policy that allows for the distribution of tickets without them being treated as gifts. Changes included a prohibition on the disproportionate use of tickets by any City Official, section 3.4, and the definition of the term “Fair Value” for the purpose of publicly reporting the value of tickets, section 2.4.
