FROM: DEPARTMENT OF PUBLIC WORKS AND DEPARTMENT OF

SUBJECT: AWARD OF CONSTRUCTION CONTRACT FOR
OAK CANYON NATURE CENTER RENOVATIONS
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion:
1) Determine the Oak Canyon Nature Center Renovations (Project) is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to Class 2, Section 15302 (reconstruction), Class 3, Section 15303 (new construction) and Class 11, Section 15311 (accessory structures) of Title 14 of the California Code of Regulations; and
2) Award the construction contract to the lowest responsive and responsible bidder, Armstrong Cal Builders, Inc., Rancho Signal Hill, CA, Contractor’s License No. 990992, Classification A and B, in the amount of $1,118,000 for the Project; authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions.
DISCUSSION:
The Project consists of the renovation to the existing amphitheater, installation of educational exhibits and interpretive panels, improved decomposed granite trails, upgraded parking lot, lighting improvements, installation of a wooden pedestrian deck, and other appurtenant work as shown on the approved plans and specifications.
Determination of the lowest responsive and responsible bidder for the selected project scope was made in accordance with Public Contract Code 20103.8(d).
The bids are summarized as follows:
1. A2Z Construct, Inc., Rancho Santa Margarita, CA .................................$800,000.00
2. Armstrong Cal Builders, Inc., Signal Hill, CA......................................$1,118,000.00
3. MBC Enterprises, Inc., Huntington Beach, CA.....................................$1,321,193.25
4. Bedrock Group, Inc., La Canada, CA....................................................$1,375,000.00
5. Faris Construction Company, Oceanside, CA .......................................$1,595,000.00
6. MLC Constructors, Inc., Corona, CA....................................................$1,828,803.00 Award of Construction Contract for Oak Canyon Nature Center Renovations September 26, 2023
The City received six (6) bids on September 7, 2023. The lowest bidder submitted a request for withdrawal of bid due to a clerical error in their bid package with the appropriate backup documentation. After careful examination of the supporting documentation, staff confirmed the contractor’s mistake on the bid. Therefore, pursuant to the Public Contract Code Section 5103, the lowest bidder was relieved from the obligation of bid without forfeiting their bid bond. The selected bid price reflects the current bidding environment, is consistent with the engineer’s estimate, appears to be reasonable, and is within the available funding. Construction is scheduled to begin in Fall 2023 and is scheduled to be completed by late Winter 2024. Liquidated damages are set for $1,500 per day.
COMMUNITY WORKFORCE AGREEMENT (CWA):
This Project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles / Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. The scope of the Well Construction does not meet the definition of “Project Work” as defined in the CWA; therefore, this construction is exempt.
ENVIRONMENTAL REVIEW:
In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.
Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 2, Section 15302 (reconstruction), Class 3, Section 15303 (new construction) and Class 11, Section 15311 (accessory structures) of Title 14 of the CCR which consists of reconstruction of the existing amphitheater, new construction of new small structures within the project site, providing access for those with disabilities, and interpretive signage.
After determining that this Project is categorically exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.
IMPACT ON BUDGET:
This Project is funded by development impact fees and State funding from the Department of Parks and Recreation (Outdoor Environmental Education Facilities grant). Sufficient appropriation is included in the Community Services Department’s FY 2023/24 Capital Improvement Program budget.
Respectfully submitted, Concurred by, Rudy Emami Sjany Larson-Cash Director of Public Works Director of Community Services Award of Construction Contract for Oak Canyon Nature Center Renovations September 26, 2023
